THE AUGUSTINE CO. 12600 -12.26 <br />decree of heirship, an order of distribution, and a final settlement thereon and discharge. <br />For these purposes the 27th day of April, 19390 at 10 o'clock A.M. at the County Court Room in said <br />County was assigned as the time and place for hearing said petition, examining and allowing said <br />account, and it was ordered that notice of the pendency of said petition be given to all persons <br />interested in said estate by publishing a notice of said order in the Grand Island Independent, a <br />legal newspaper printed and published in said County, three successive weeks prior to said day of <br />hearing; and it appears by proof on file that said notice was given as ordered by the Court. <br />FINDINGS. <br />THE COURT FINDS AS FOLLOWS: <br />1. <br />Upon an examination of the record and the evidence in this matter and being duly advised in the <br />premises, the Court finds as follows: That William Scheffel, also known at times as Wilhelm Scheffel, <br />departed this life on the 26th day of.December, 1933, in said Hall County, Nebraska, testate, and <br />at the time of his death he was a resident of said County, and that the deceased left a labt will <br />and codicil thereto which was filed in this Court for probate on the 5th day of January, 1934. <br />2. <br />That Catharina Scheffel was nominated in said will as executrix thereof but that she predeceased <br />the said William Scheffel in death and was not living on the 5th day of January, 1934, and the <br />following are the legatees, devisees and heirs at law named in said will: Carl L. Scheffel, William <br />F.Scheffel, also known as William Scheffel, Rudolph Scheffel, Louis Scheffel, Katie Meyer, also <br />known as Katie Mayer, Flora Scheffel, Matilda Langenheder, also known as Tillie Langenheder. <br />3, <br />That on the 5th day of January, 1934, said Katie Meyer, Flora Scheffel, Matilda Langenheder, Carl <br />L.Scheffel, William F.Scheffel, Rudolph Scheffel and Louis Scheffel, filed in this court a petition <br />for the probate of said will and codicil and for the appointment of the said Carl L.Scheffel and <br />William F.Scheffel as Administrators with the Will Annexed thereof and on said 5th day of January, <br />1934, an order of this Court was made therein assigning the 30th day of January, 1934, at 10 o'clock <br />A.M. at the County Court Room in said County, as the time and place for hearing said petition, and <br />ordering that notice be given all persons interested in said matter by publishing a notice of said <br />order in the Grand Island Independent a legal newspaper printed and published in said County three <br />successive weeks prior to said day of hearing, and it appears by proof on file that notice of said <br />order was given as ordered by this Court. <br />4. <br />The Court further finds that on said 30th day of January, 1934, said will and codicil was duly <br />proved and allowed as the last will and codicil of William Scheffel deceased, a decree of probate <br />was made thereon and the said Carl L.Scheffel and William F.Scheffel were, upon their giving bond <br />in the sum of $10,000.00 as ordered by this Court, appointed Administrators with the Will Annexed <br />thereof and that they filed said bond and qualified according to law and entered upon the duties <br />of that office; the Court further finds that the deceased at the time of his death was a resident <br />of said Hall County and that he left the following heirs at law: Carl L.Scheffel, William F.Scheffel, <br />also known as William Scheffel, Rudolph Scheffel, Louis Scheffel, Katie Meyer, also known as Katie <br />Mayer, Flora Scheffel, Matilda Langenheder, also known as Tillie Langenheder; that said will and <br />codicil are in words and figures as follows, to -wit: <br />THE LAST WILL OF WILLIAM SCHEFFEL <br />I. William Scheffel, make this my last will hereby revoking all former wills. <br />I appoint my dearly beloved wife Catharina Scheffel, executrix hereof and provide�`she need give no <br />bond. <br />All my peraonal property I give my wife absolutely, excepting what I shall hereinafter dispose of. <br />
