<br />The East twenty -six and tyro- thirds (26 -2/3) acres of the East Half of the Northeast Quarter of Sec-
<br />tion 5, Township 101, North,Range 9,West of the 6th P.M., Hall County, Nebraska, containing 26 -2/3
<br />acres.
<br />Government Lot 7 of Section 16,Township 10,North,Range 9, West of the 6th P.I., Hall County, Nebraska,
<br />containing 12.30 acres.
<br />Lot 2 in Section 1, Township 9, North,Range 11, West of the 6th P.M. Hall County, Nebraska, contain-
<br />ing 7 acres.
<br />which according to the provisions of the last will and testament of said deceased, after the deelin ..
<br />ation of the widow to take under the terms of the will, descends and is assigned as follows:
<br />To Bertha Schaupdach, widow of said deceased, an undivided one third interest in said real estate;
<br />To Willie Schaupdach, Alfred Schaupdach,Christ Behaupdaeh, Emil Schaupdachy and John Schaupdach,Jr.,
<br />each an undivided tiro- fifteenths interest in said real estate.
<br />IT IS,THEREFORE, CONSIDERED ORDERED, ADJUDGED AND DECREED by the Court that the final account of said
<br />Bertha Schaupdach and The First National Bank of Grand Island, Executrix and Executor, respectively,

<br />of the estate of John Schaupdach, deceased, be and the same is hereby in all things approved, con-
<br />firmed and allowed; that all claims against said estate, if any such there be, are forever barred
<br />and excluded; that upon the payment of the costs of administration and the delivery of the possession
<br />of the real estate, and the filing in this court of receipts of heirs and legatees, the said Bertha
<br />Schaupdach and The First National Bank of Grand Island,Executrix and Executor, respectively will be
<br />discharged from their trust as Executrix and Executor, and the sureties on their official bond will
<br />be released.
<br />That under the last will and testament of said deceased, and under the law of the State of Nebraska
<br />in so far as said will was modified by the declination of Bertha Scraupdach,widow, to take under
<br />said last will and testament, the real estate described, to -wit:
<br />All of the Southwest Quarter of the Northeast Quarter of Section 4, in Township lO,North,Range 9,
<br />West of the 6th P.M., except that part conveyed to Claus Obermuller by Warranty Deed recorded in
<br />Book "F" of Deeds at page 123. Also a part of the Southeast Quarter of the Northeast Quarter in
<br />Section 4, in Township 10, North, Range 9, West of the 6th P.M., more particularly described as
<br />follows Commencing at the northeast corner of the Southwest Quarter of the Northeast Quarter of
<br />Section 4, Township 10, North,Range 9, West of the 6th P.M., running east thirty -five (35) feet,
<br />thence south seventy -eight (79) rods, thence west thirty -five (35) feet, thence north seventy -eight
<br />(79) rods, to the place of beginning;
<br />Commencing at a point two (2) rods west of the center stake of Section 4, Township 10,North,Range
<br />9,West of the 6th P.M., and running thence North two (2) rods thence east eighty -two (82) rods,
<br />thence south two (2) rods, thence west eighty -two (82) rods to the place of beginning;

<br />The Southeast Quarter of the Northeast Quarter and the Northeast Quarter of the Southeast Quarter
<br />In Section 4, Township lO,North,Range 9,West of the 6th P.M., less that tract of ground described
<br />in the Deed from Claus Obermuller and wife to John Lassen which is recorded in Book F at page 122
<br />of the records of the said County, and a part of the Southwest Quarter of the Northeast Quarter
<br />in said Section, more particularly described as follows, to -wit: Commencing at the northeast corner
<br />of the southwest Quarter of the Northeast Quarter of Section 4, Township 10,North Range 9,West of
<br />the 6th P.I., and running thence east thirty -five (35) feet, thence south at right angles seventy -
<br />eight (78) rods, thence west at right angles thirty -4five (35) feet, thence north seventy -eight
<br />rods to the place of beginning.
