<br />the court, being fully advises in the premises, after examining the records and files in this case
<br />finds:
<br />That due and legal notice has been given to all persons of.the filing of said Final Report, and
<br />that there are no objections thereto on file.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that said Final Report of Gustave N.
<br />Cornelius, Executor, be and the same is hereby allowed, and the same is hereby in all things approved
<br />and confirmed.
<br />The Court further finds that no claims have been filed in this estate; that the time fixed for filing
<br />claims has long since elapsed; that notice of the time for filing claims has been given in the man-
<br />ner and form provided by law;
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that all claims not now on file in this
<br />estate be and the same are hereby forever barred and precluded. .
<br />The Court further finds that all the court costs and expenses of administering this estate and
<br />attorney fees have been paid in full; that said estate is not subject to inheritance tax, either
<br />Federal or State.
<br />The court further finds that the said Marie L.Cornelius died at her residence in Hall County,
<br />Nebraska on June 17, 1937; that she was at the time of her death a citizen and resident of Hall
<br />County and of the State of Nebraska; that she left surviving her as her sole and only heirs at
<br />law her husband, Gustave N.Cornelius and one son, Walter Cornelius, of lawful age, and that there
<br />are no other heirs at law, or the issue of any deceased child.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that said Marie L.Cornelius died testate
<br />on June 17, 1937, a citizen and resident of Hall County and the State of Nebraska; that she left as
<br />her sole and only heirs at law, Gustave N. Cornelius, her husband, and one son, Walter Cornelius.
<br />The court further finds that all the funeral expenses of the said Marie L.Cornelius and expenses
<br />of her last illness have been paid in full.
<br />The court further finds that said Gustave N.Cornelius has receipted for all the residue of said
<br />estate.
<br />The Court further finds that said Marie L.Cornelius was at the time of her death the owner of Lot
<br />Five (5), Block Five (5), Windolph's Addition to the City of Grand Island,Nebraska, and that under
<br />the terms and conditions of said last Will and Testament said premises was devised as follows,
<br />to -wit:
<br />To Gustave N.Cornelius for the term of his natural life, and at his death, then to Walter Cornelius,
<br />and to his heirs forever, in fee simple absolute, provided, however, that during the lifetime of
<br />the said Gustave N.Cornelius, neither he nor Walter Cornelius shall sell, mortgage, alienate or
<br />lien said real estate in any manner whatsoever, and provided further that so long as Gustave N.
<br />Cornelius shall not desire to occupy said real estate, that Walter Cornelius shall have a prior
<br />option to rent said premises at the same price as is elsewhere obtainable.
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that said real estate is hereby set off
<br />unto Gustave N.Cornelius and Walter Cornelius in accordance with the terms of said last Will and
<br />Testament.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that Gustave N.Cornelius be and he is
<br />hereby discharged as Executor of said estate, and said estate be and the same is hereby closed.
