Paul N.Kirk <br />(SEAL) County Judge <br />IN THE COUsITY COJaT OF HALL COUNTY, NEBRASKA <br />IN THE MAT LlER OF '_THE ESTATE OF ) <br />FINAL DECREE <br />RICHARD P.BOOTH,deceased ) <br />STATE OF NEBRASKA ) <br />SS At a session of the County Court held in and for said County of Hall <br />COUNTY OF HALL ) <br />this 5th day of.January,1938, Present Paul N.Kirk,County Judge. <br />BE IT REMEMBERED,that on the 10th day of Decernber,1937,Arthur C.Ma.yer,as executor of the estate <br />of Richard P.Booth,deceased filed in this court his final account as such executor and a petition <br />praying that said account be allowed;for a decree of heirship,an order of distribution,a final <br />settlement thereon and discharge. <br />For these purposes the 5th day of January,1939,at 10 o'clock A.M.in the County Court Room in said <br />County,was assigned as the time and place for hearing said petition,examining and allowing said <br />account;and it was ordered that notice of the pendency of said petition be given to all persons <br />interested in said estate by publishing a notice of said order in the Grand Island Independent, <br />a legal newspaper printed in said county for three weeks prior to said day of hearing;and it <br />appears by proof on file that said notice was given as ordered by Court and upon examination of <br />the record-and the evidence in this matter and being duly advised in the premises,the Court finds <br />as follows; <br />1.That Richard P.Booth departed this life on the 24th day of June,1934,in Hall County,Nebraska, <br />testate,and at the time of his death he was a resident of Hall County,Nebraska. <br />$.That on the 2nd day of July,1934,Arthur C.Mayer filed a written instrument purporting to be the <br />last will and testament of said Richard P.Booth and his petition praying for the allowance of said <br />instrument as and for the last will and testament of said Richard P.Booth,deceased;and on the 2nd <br />day of July,1934,an order of this Court was made therein assigning the 26th day of July,1934,at <br />10 o'clock A.M.in the County Court Room in said County as the time and place for hearing said petit - <br />ion,and order ing that notice be given to all persons interested in said matter by publishing a <br />copy of said order in the Grand Island Independent,a legal newspaper printed in said County for <br />three successive weeks prior to said day of hearing and it appears by proof on file that notice of <br />said order was given as ordered by this Court. <br />3.The Court further finds that a hearing was had on said petition in accordance with said notice <br />and said written instrument was duly allowed by this Court as and for the last will and testament <br />of said Richard P.Booth,deceased,and that Arthur C.Mayer,nominated therein as executor of said <br />last will and testament,was duly appointed executor in this estate upon his giving bond in the <br />sum of $500.00 as ordered by this Court;the Court further finds that deceased at the time of his <br />death,was a resident of Hall County,Nebraska;that said executor filed a good and sufficient bond <br />herein on the 25th day of July,1934,and thereupon qualified as executor herei.n,and on the 26th day <br />of July,1934,Letters Testarrientry -were issued herein by this Court to said Arthur C.Mayer. <br />4. That on the 26th day of July,1934,an order of this Court was made allowing creditors three months <br />from and after the 23rd day of August,1934,in which to file their claims against this estate and <br />further ordering a notice of the same be published in the Grand Island Herald,a legal newspaper <br />published and circulating in Hall County,Nebraska,f or three successive weeks prior to the 23rd day <br />
