<br />fourteen (14),township ten (10),Range Twelve (12), all West of the 6th P.M.,in Hall County,Nebraska,
<br />and is a proper person to ♦prosecute this proceeding.
<br />The Court finds that the said ,Villiwri W.Costello left surviving him as his heir at law and only_
<br />heir at law,his father,Thomas Costello;and that under the laws of the State of Nebraska,in force
<br />at the time of the date of the death of the said 17illiam W.Costello,the real estate hereinbefore
<br />mentioned passed and descended to said father,Thomas Costello.
<br />The Court finds that the funeral expenses of said deceased have been paid and that all debts of the
<br />deceased and of his estate,if any such existed,are forever barred and precluded,and that the costs
<br />of these proceedings have been paid.
<br />The Court further finds that the said ?°Jilliam W. Costello did not occupy any part of said premises
<br />as his homestead at the time of his death,and that this estate is not and was not subject to in-
<br />heritance tax,under the laws of the State of Nebraska.
<br />IT IS THEREFORE ORDERED,ADJUDGED AND DECREED BY THE COURT that the said William II.Costello died
<br />intestate in Hall County,Nebraska on the 22nd.day of Novernber,1892,that more than forty -five years
<br />have elapsed since th+eath of the said William 11.0ostello;th at no application for the appointment
<br />of an administrator of his estate has ever been made,nor has there ever been any administration
<br />upon the estate of said deceased in the State of Nebraska;that said deceased died aeized as the
<br />owner in fee simple title of-the real estate hereinbefore described,situated in Hall County,Nebraska;
<br />that the petitioner is a competent and qualified person to prosecute this proceedings;that said
<br />deceased left surviving him as his heir and only heir at law his father,Thomas Costello;that upon
<br />the death of the said William 17. Costello,the real property hereinbefore described descended in
<br />absolute title to Thomas Costello.
<br />IT IS FURTHER ORDERED,ADJUDGED AND DECREED BY THE COURT that all debts of said deceased,and of his
<br />estate,if any such there be,are forever barred and precluded,and further administration of said
<br />estate is hereby dispensed with,and said estate is finally settled and forever closed.
