<br />2. That all of the real estate described in the foregoing findings, and all of the stocks, bonds
<br />and notes as hereinbefore described, be and the same are hereby assigned absolutely to Wilhelmine
<br />Lembach, all as provided in the last will and testament of said deceased.
<br />3. That said estate, or any part thereof, is not liable for an inheritance tax.

<br />William y'G. Costello,Deceased.
<br />NOW,on this 12th day of January,1938,this cause came on for hearing upon the petition of Gilmore
<br />R.Wiseman,praying for the settlement of said estate,for a determination of the heirship and right
<br />of descent of the real estate belonging to William V.Costello,and the degree of kinship of his
<br />heir or heirs at law,and a decree settling his estate.
<br />AND,it appearing to the court from the proofs on file herein that due and legal notice has been
<br />given by publication for three successive weeks,as by law and the order, of this court provided,
<br />to all creditors,heirs at law,and other persons interested in said estate,of the filing of said
<br />petition and the time and place fixed for the hearing on the sarne,and there being no objections
<br />thereto,this case was duly submitted to the court upon the petition and the evidence in support
<br />thereof,and the court being duly advised in the premises finds that the allegations in said petit-
<br />ion are true,and that said William W.Costello died intestate in Hall County,Nebraska on the 22nd
<br />day of November,1892,being at the time of his death a resident and inhabitant of Hall County,
<br />Nebraska,that said William W,Costello died seized as the owner in fee simple title of the follow-
<br />ing described property: The west half of the northwest quarter (Wt2 NWJ) of Section Thirteen (13),
<br />and the South half of the east half of the northeast quarter of section Fourteen (14),all in
<br />Township Ten (10),Range Twelve (12),West of the 6th P.M.,in Hall County,Nebraska,and Lot Nine (9)
<br />in Block Six (6) in Russel Wheeler's Addition to the City of Grand Island,Hall County,Nebraska;
<br />that more than forty -five years have elapsed since his death,and that no application has ever been
<br />made in the State of Nebraska for the appointment of administrator of his estate and no petition
<br />has been filed for that purpose,and no administration has ever been had upon the estate of William
<br />W.Costello.
<br />The Court finds that the petitioner,Gilmore R.Wiseman is the present owner of the west half of the
<br />northwest quarter (Wyl NWV) of Section ,Thirteen (13) ,Township Ten (10) and that petitioner and his
<br />wife are the present owners of the south half of the east half of the northeast quarter of section
<br />
