56 WILL AND DECREE RECOR30 <br />THE AUGUSTINE CO. 18600 -12-86 <br />A.Lembach, deceased, which was filed in this Court, on the 29th day of June, A.D. 1937,and being <br />the instrument to which this is annexed, was duly proved, approved, probated and allowed, as the <br />last will and testament of the said Anthony A.Lembach, deceased, in and for the State of Nebraska; <br />and it was ordered to be recorded in the records of the County Court aforesaid. <br />IN WITNESS WHEREOF I have hereunto set my hand and the Seal of said County Court, at Hastings, this <br />17th day of July, A.D. 1937. W.Halsey Bohlke <br />(SEAL) County Judge <br />That on the 17th day of July, 1937, Wilhelmine Lembach was by this court duly appointed executrix <br />of said will and estate, and on that date she qualified as such and has been acting in that capacity <br />since. <br />That�due notice was given to creditors to file claims, if any, against said estate; that one claim <br />only was filed, that of the City National Bank, Hastings, Nebraska, in the sum of $2000.00; that <br />on the 26th day of November, 1937, this court made and entered an order allowing the above claim <br />and made and entered -an order barring all other claims against said estate. <br />That said deceased died seized and possessed of the following described real estate, to -wit: <br />Lot 7, in Block 9, East Park Addition to Hastings, Nebraska, which was the homestead of the deceased <br />and is now the homestead of his widow Wilhelmine Lembach. <br />Part of Block S in Alexander's First Addition to Hastings, Nebraska, more particularly described <br />as follows: Commencing 175 feet west of the Southeast corner of the North Half of the South Half; <br />thence North 72 feet; thence West to the east line of Burlington Avenue; thence South 72 feet; thence <br />East to the place of beginning. <br />All of the above in Adams County, Nebraska, also <br />The Southwest Quarter of Section 231 township 11, north, range 10, and Lots 1 to 16 inclusive, ex- <br />cept Lots 3 and 4, in Garland Place, a subdivision of the North Half of the Southeast Quarter of <br />Section 23, township 11, north, range 10. <br />All West 6th P.M., in Hall County, Nebraska. <br />That on the 8th day of December, 1937, said executrix filed in this court a final report of the <br />amounts by her collected and disbursed, which shows the payment by her of the sum of $4163.09 in <br />excess of the amount by her received, which amount was advanced by her, she being the sole residu- <br />ary legatee under the will of said deceased. <br />That as shown by said final report, the said executrix has reduced to cash all of the estate of <br />said deceased except certain bonds, notes and stocks,; as follows; <br />One note dated October 1, 1935, signed by Brach's Inc. in the principal amount of $1000.00 on which <br />has been paid the sum of $50.00. <br />One note dated March 15, 1932, signed by Fred Goebel, in the principal sum of $23.00. <br />One note dated January 1, 1936, signed by W.A.Reutlinger, in the principal sum of $10,000.00. <br />Also the following stocks and bonds: <br />Certificates No. 18, 190 20 and 71, issued by Polenske Brothers Schellak & Company <br />Bonds No. 9334 -B and 23230 -B issued by The Clarke - Buchanan Company now in receivership: <br />Certificate No. 66, 1 share, Adams County Agricultural Association; <br />Certificate No. 60, issued by Brach's Inc <br />Receiver's Trust Receipt, Ctf. No. 1384, originally for $542.67 issued by the First National Bank, <br />Hastings, Nebraska, now in receivership <br />That said executrix as the sole residuary legatee has.elected to take an assignment of said stocks, <br />notes and bonds, instead of having them sold on the open market. <br />That on this date testimony was heard regarding the value of said estate for inheritance tax pur- <br />poses; Edmund Nuss, county attorney, present and participating, and the court finds that the value <br />of the estate is less than is exempt under the laws of the state of Nebraska, the widow Wilhelmine <br />Lembach, as heir of said deceased, being entitled to one -half of said estate by law, and entitled <br />to an exemption of $10,000.00 in excess of said amount, which is less than the total value of said <br />estate, and the court finds that there is no inheritance tax due. <br />The court further finds teat in business transactions, said deceased was also known and named as <br />A.A.Lembach, and that Anthony A Lembach, Anton Lembach and A.A.Lembach was the same and identical <br />person. <br />The court further finds that said executrix having in all things complied with the law, she is <br />entitled to be discharged as such executrix, and her letters testamentary cancelled and annulled. <br />IT IS- THEREFORE BY THE COURT ORDERED, ADJUDGED AND DECREED: <br />1. That the report of said Wilhelmine Lembach, executrix, be and the same is hereby in all things <br />allowed, approved and confirmed as her final report, and there being no balance in her hands as. <br />I <br />I[] <br />L�' <br />
