<br />The court further finds that Union Loan & Savings Association had a mortgage upon the above des-
<br />cribed premises and foreclosed said mortgage and is now the ovine.r thereof; that in order to obtain
<br />a decree of heirship in this case, it has advanced to the Administrator the sum of $28.00, being the
<br />court costs incurred to this date, and in the sum of 425.00, fee for the attorney for the Adminis-
<br />trator, and is entitled to be subrogated therefor.
<br />The Court further finds that there are assets which will require administration.
<br />The Court further finds that the said. George Gingherick left no last Will .,nd Testament. v
<br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the Court that the said George Gingherick, otherwise
<br />known as George 1i.Gingherick, died on the 16th day of March, 193('D, intestate and a resident of Hall
<br />County, Nebraska, that he left no widow him surviving, nor any child or children of any deceased
<br />child or children; that his sole and only heirs at law are the following named persons:
<br />Jeannette Sandoz,
<br />Prudence Aus °ustine,
<br />Mildred E.Gingherick, and
<br />Carnp Harvey Gingherick,
<br />children of the said George Gingherick; that at the time of his' death he was the owner in fee simple,
<br />subject to s. mortgage, of the real estate hereinbefore described.
<br />It is further ordered, adjudged and decreed by the Court that the above described real estate be
<br />and the same is hereby set off to the above named children, share and share alike, as tenants in
<br />common, and they are hereby decreed to be the sole and only heirs at law of the said George Gingher-
<br />ick, deceased.
<br />It is further ordered, adjudged and decreed by the Court that Union Loan& Savings Association
<br />be and the same is hereby subrogated to the extent of $53.00 for the court costs and attorney fees
<br />paid '?y it, and the Adr_:inistrator is hereby ordered to repay to said Union Loan 4nd Savings Asso-
<br />ciation said sum out of any assets that may come into his hands or possession prior to the payment
<br />of any claims filed herein.
<br />It is further ordered, adjudged and decreed by the Court that the administration of this estate is
<br />hereby kept open until the further order of the court.
