36 WILL AND DECREE RE <br />THE AUGUSTINE CO. 18600.12.86 <br />CERTIFICATE OF PROBATE OF WILL <br />STATE OF NEBRASKA ) At a session of the County Court held in the County Court Room in Grand <br />SS <br />COUNTY OF HALL ) Island, in said County, on the 13th day of April, A.D., 1937. <br />Present Paul N.Kirk, County Judge <br />In The Matter of The Estate <br />of <br />William A.Fitehhorn,deceased. <br />I, Paul N.Kirk, Judge of the County Court in and for said County, do hereby certify that on the <br />17th day of March, 1937, duly authenticated copies of an instrument purporting to be the last will <br />and testament of William A.Fitchhorn, deceased, were filed for probate in this Court. That on the <br />13th day of April, 1937, said instrument to which this certificate is attached was duly proved, <br />probated and allowed as the last will and testament of the real and personal estate of said William <br />A.Fitchhorn, deceased, and the same was ordered to be recorded in the records of the Court aforesaid. <br />In witness whereof I have hereunto set my hand and affixed the seal of the County Court this 13th <br />day of April, 1937• <br />Paul N.Kirk,County Judge <br />That thereupon this Court fixed the bond of the executrix named in said will in the sum of $500.00, <br />which bond wds filed and duly approved -ard the oath by her as executrix herein, was duly taken and <br />filed on said 13th day of April, 1937; that thereupon on the 14th day of April, 1937, this Court <br />made an order giving notice to creditors to file their claims with proof thereof in this office, <br />for examination and allowance and that all claims outstanding against said estate, not so filed <br />within the time limit shall be forever barred and this Court further ordered that a hearing on the <br />claims filed in this estate be had at this office on the 11th day of August 1937; that the only <br />claims filed and allowed was the claim of the said Abbiebelle Fitchhorn in the amount of $558.94 <br />for money advanced during the last illness of deceased, the funeral expenses, railroad fare, main- <br />tenance of widow, marker on grave and 1935 real estate taxes, which amount was paid by said Abbie- <br />belle Fitchhorn for and on behalf of said estate and on the 13th day of August, 1937, this Court <br />made an order allowing said claim and ordered the same to be paid when there may be funds on hand <br />to do so. <br />The Court further finds that said executrix has paid court costs in the sum of $78.70 and has de- <br />posited $5.00 with the Court as indemnity for filing fees with the Recorder of Deeds of said Hall <br />County for the recording of this decree and will and that she has paid Mayer & Mayer, Attorneys <br />fees for services rendered herein, the sum of $100.00 or a total of $742.64; that she has taken <br />possession of the personal property of the deceased of the value of $75.00 for which this estate <br />is entitled to credit, and that there is due said executrix upon the claim heretofore allowed and <br />for court costs and attorneys fees advanced, the net sum of $667.64,which amount is due her out <br />of this estate and for which she is entitled to a lien on the real estate, a part of this estate <br />and described in this decree. <br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that all persons holding claims against said deceased, <br />excepting the said Abbiebelle Fitchhorn, who is entitled to $667.64 *hich is made a lien upon said <br />real estate, are forever barred from prosecuting or presenting any claims whatsoever. <br />The Court finds that all court costs and fees have been paid, that this estate is not subject to <br />inheritance tax, both inheritance tax to the County of Hall and State of Nebraska, nor estate tax <br />to the United States of America; that said real estate by the terms of said will, descended to <br />Abbiebelle Fitchhorn for and during the term of her natural life and at her death shall pass to the <br />zaid William A.Fitchhorn, Albert Fitchhorn and Walter Fitchhorn in equal sharee, and to their res- <br />pective heirs and assigns forever; that the executrix herein has done everything that should be done <br />and that this estate has been fully administered and that said executrrix be discharged and this <br />estate closed.
