<br />All of said land being in Township Ten (10) North, Range Eleven (11), West 6th P.M. in Hall County,
<br />Nebraska.
<br />and which shad remain a lien upon said premises until fully paid and satisfied, with interest at
<br />7% from the date of this decree.
<br />The Court further finds that William A.Fitchhorn, the above -named deceased, departed this life
<br />testate on the 29th day of May, 1936, a resident of the State of New Jersey, leaving as his only
<br />heirs -at -law, Abbiebelle Fitchhorn, his widow, and William A.Fitchhorn, Albert Fitchhorn and
<br />Walter Fitchhorn, his three sons, all of whom are over the age of twenty -one years; that on the
<br />16th day of July, 1936, the will of said William A.Fitchhorn was duly admitted to probate in the
<br />Surrogate and Orphans Court of said Salem County, New Jersey, an authenticated copy of said will
<br />and the probate thereof in said Court were filed in this Court on the 17th day of March, 1937, and
<br />thereupon this Court made an order that all persons interested in this matter appear in this court
<br />on the 13th day of April, 1937, to show cause why said foreign will should not be admitted to pro-
<br />bate in this Court, which order and notice of hearing was duly published in said Grand Island Daily
<br />Independent three successive weeks and no one having filed objections or having appeared in oppo-
<br />sition to admitting said will to probate in this Court, an order was made admitting said foreign
<br />will to probate in this Court on said 13th day of April, 1937.
<br />Said will with certificate of probate by said Surrogate and Orphans Court and certificate of
<br />probate in this Court is in words and figures as follows:
<br />I, William A.Fitchhorn, being of sound mind, memory and understanding, do make, publish and declare
<br />the following to be my last will and testament, viz:
<br />First - I order and direct my executrix,hereinafter named, to pay all my just debts and funeral
<br />expenses, including all transfer inheritance taxes, estate taxes or death dues that may be levied
<br />against my estate or against any part, share or interest therein, as soon as conveniently may be
<br />after my decease .
<br />Second - I give and bequeath unto my wife, Abbiebelle Fitchhorn, all of my personal property that
<br />I may own at the time of my decease..
<br />Third - I give, devise and bequeath all of my real estate situate in the County of Salem, State of
<br />New Jersey, and in the State of Nebraska, and any other real estate wheresoever situate, to mfr/
<br />wife, Abbiebelle Fitchhorn, for and during the term of her natural life, she to have the use and
<br />income of the same as long as she may live.
<br />Fourth - Upon the death of my wife, Abbiebelle Fitchhorn, I direct that my said real estate be
<br />then divided equally among my three sons, William A.Fitchhorn, of Elmer, N.J., Albert Fitchhorn
<br />of Upton, Wyoming, and Walter Fitchhorn of Grand Island,Nebraska, share and share alike.
<br />Fifth - The bequests hereinabove made to and for the benefit of my said wife are to be by her re-
<br />ceived in lieu and bar of her dower and dower rights in my estate.
<br />Sixth - I hereby nominate and appoint my wife, Abbiebelle Fitchhorn, to be the executrix of this,
<br />my last will and testament, hereby revoking any and all wills by me at any time heretofore made
<br />and declaring this only to be and contain my last will and testament.
