31- <br />No. 7 HALL COUNTY <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />CERTIFICATE. <br />STATE OF NEBRASKA ) I, Paul N.Kirk, County Judge of Hall County, Nebraska, do hereby certify <br />}ss. <br />HALL COUNTY ) that I have compared the foregoing copy of Final Decree entered IN THE <br />UKTTER OF THE ESTATE OF JAMES W.GARNETTE, DECEASED, with the original record thereof, now remaining <br />In said Court, that the same is a correct transcript thereof, and of the whole of such original <br />record; that said Court is a Court of Record having a seal, which seal is hereto attached; that <br />said Court has no Clerk authorized to sign certificates in his own name, and that I am the legal <br />custodian of said Seal and of the Records of said Court, and that the foregoing attestation is in <br />due form of law. <br />IN TESTIMONY WHEREOF I have hereunto set my hand and affixed the seal of the County Court, at <br />Grand Island, this 7th day of October, 1937- <br />Paul N.Kirk <br />(SEAL) County Judge <br />Filed for record this 7 day of October, 1937, at 4 :45 o'clock P.D. <br />Register of Deeds <br />0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-o-0-0-0-0-0-0-0-0-0- <br />DECREE OF HEIRSHIP: 'V\ <br />IN THE COUNTY COURT OF HALL COUNTY :NEBRASKA. <br />IN THE MATTER OF THE ESTATE ) <br />DECREE OF HEIRSHIP <br />OF <br />BERNHARD AUGUST NIEMOTH,DECEASED <br />This cause coming on for hearing on this 19th day of October,1937,upon the application of Frank <br />T.Niemoth,the duly appointed,qualified and acting Administrator of the Estate of Bernhard August <br />Niemoth,deceased,praying for a determination of heirship in the above entitled matter,and the <br />Court being fully advised in the premises from the evidence adduced,finds that the aforesaid <br />estate has been duly admitted to probate and that the Court has acquired juridiction of the subjetit <br />matter and of all the heirs,creditors and other persons interested in said estate;that the deced- <br />ent,Bernhard August Niemoth,died intestate on the 24th day of December,1933,a resident and inhab- <br />itant of Hall County,Nebraska,and was then seized of various parcels of real estate situated in <br />Hall County and Howard County,Nebraska,described as follows , to -wit: <br />The South Half of the Northwest Quarter ( N1) of Section Fourteen (14) and the South Half of <br />the Northeast Quarter (Sj NEJ) of Section Fifteen (15 ) Township Twelve (12) ,North,Range Nine (9); <br />West of the 6th P.M.,Hall County,Nebraska; The South Half of the Southwest Quarter of the North- <br />west Quarter ( Sg sWj NWj) of Section Nine (9) ,Township Twelve (12) ,North Range Nine (9) ,West of <br />the 6th P.M. ,Hall County,Nebraska; The West Half ('tâ–º11j) of Section Twenty -eight (29)Township Thirt- <br />een (13) North Range Ten (10) )West of the 6th P.M. ,Howard County,Nebraska; that proceedings are <br />now pending in the County Court of Hall County,Nebraska,for the administrator of said estate;that <br />all claims allowed against said estate have been paid;that the real estate hereinabove described <br />is now being partitioned'in an action pending in the District Court of Hall County,Nebraska. <br />The Court further finds that the said Bernhai °d August Niemoth left surviving him seven brothers <br />and sisters,viz.; 'William Niemoth,of Purdum,Nebraska,Louisa Lamm of St.Libory,Nebraska, and Edward <br />Niemoth,Herman Niemoth,Joe Niemoth,Christ Niemoth,and Emma Gosda,all of Grand Island,Nebraska; <br />that they are all of legal age;that they are the sole and only heirs-at -law of the estate of <br />Bernard August Niemoth,deceased,and the only persons interested therein ;that the said Bernhard <br />August Niemoth was a single man at the time of his death and that his parents preceded him in <br />death. <br />IT IS THEREFORE CONSIDE1=E ADJUDGED,AND DECREED BY THE COURT that the said Bernhard August Niemoth <br />died intestate on the 24th day of February,l933,a resident of Hall County,Nebraska;that he died <br />
