<br />ancillary proceedings, covering real property there, and due to the further fact that the Federal
<br />Estate Tax has been paid, but not finally audited;
<br />THE COURT FURTHER FINDS that at the time of the approval of the First Report and Account Current,
<br />there was allowed to said Administratrix on account of ordinary fees, the sum of 01,500600, which
<br />has not been paid, and to Kenneth A.Davis, attorney for said petitioner, on account of ordinary
<br />fees, the sum of $1,500.00, which, together with $200.00, included in said First Account Current,
<br />represents the sum of $1700.00 in all allowed to said attorney on account of ordinary fees; and
<br />that said s,.-ms have been paid;
<br />THE COURT FURTHER FINDS that since the filing of the First Account Current it has been discovered
<br />that Parcel 50 of the Inventory, listed as Certificate #4, for 423 shares of Two Twenty -Nine
<br />Atlantic, Inc. was in point tenancy with said Administratrix as the widow of said decedent; and
<br />that said stock has, therefore, been withdrawn from said estate;
<br />THE COURT FTTRTHER FINDS that pursuant to order duly made and given herein, there has been paid
<br />to said Administratrix as widow of said decedent, a family allowance in tle sum of $500.00 a month;
<br />and that an order should be made at this time terminating said kllowance;
<br />THE COURT FURTHT'R FINDS that the inheritance taxes have been paid in the sum of $1,484.05, chargeable
<br />against the beneficiaries of said estate as follows:

<br />THE COURT FURTHER FINDS that the said William Schulz, Jr. died intestate in the City of Long Beach,
<br />County of Los Angeles, State of California, on or about the 20th day of November, 1935, leaving
<br />him surviving as next of kin and heirs, the following:

<br />THE COURT FURTHER FINDS that said Phillip Schulz, son of said decedent, is a minor, and that
<br />Ida Schulz has been appointed and now is the guardian of his estate; and that distribution hereunder
<br />for the benefit of said Phillip Schulz should be made to Ida Schulz as Guardian of his estate;
<br />THE COURT FURTHER FINDS that in order to facilitate distribution of this estatj and agreement for
<br />distribution has been entered into by all of the beneficiaries hereunder except the said Phillip
<br />Schulz; and that said agreement has been executed upon his behalf pursuant to Order of this Court
<br />in the matter of his guardianship by Ida Schulz as Guardian of his estate;
<br />THE COURT FTJRTHER FINDS that it is advisable and for the best interests of said estate and those
<br />Interested therein that the specific items of property now held in said estate, and the sum of
<br />$40,000.00 in cash, be distributed in accordance with said agreement at this time;
<br />THE COURT FTTRTHER FINKS that pursuant to provisions of §586 of the Probate Code and the Bank Act
<br />of the State of California, certain personal property and cash of said estate was deposited with
<br />the Farmers and Merchants Trust Company of Long Beach, a corporation, as Depositary; and that by
<br />process of liquidation and by release, the character of said personal property and the amount of
<br />said cash has changed; and that at the present time there is on deposit with the said Trust Company
<br />as such Depositary, the following:
<br />A. Cash in the sum of $47,196.75
<br />B. Note dated April 28, 1934, principal $2,000.00 due 3 years after date, interest 6% quarterly,
<br />made by May D.Goldie, secured by a trust deed to Peoples Escrow Corporation.
