12 WILL AND DECREE RECORD THE AUGUSTINE CO. 18600.12.86 WILL AND DECREE TN THE COUNTY COURT OF CUSTER COUNTY, NEBRASKA. IN THE MATTER OF THE ESTATE : : DECREE OF FINAL SETTLEMENT. OF JOSEPH L.HANTZ, DECEASED. : Now on this 2 >th day of May, A.D. 1937, at ten o'clock A.M. this being the time fixed by order of this court for hearing upon the petition and final account of Edwin F.M.yers, administrator, with the Will annexed of the estate of Joseph L.Hantz, deceased,said Edwin F.Myers having been appointed administrator by the County Court of Custer County, Nebraska as petitioned and having accepted said appointment, given bond and qualified as such administrator in the County Court of Custer County, Nebraska appeared in person and the evidence having been submitted and proofs and allegations hav- ing been heard the court proceeds to make final settlement of this estate, and in so doing finds from the evidence as follows: 1. That said Joseph L.Hantz died testate on the lath day of May, A.D. 1936. That at the time of his death he was a resident of Cook County, Illinois and left a Last Will and Testament and after his death the said Will was duly proved and allowed in the probate court of Cook County, Illinois, said court being the court having jurisdiction in sued matters of the state of Illinois as the Last Will and Testament of the said Joseph L.Hantz, deceased. That a true copy of the said Will together with the court certificate of probate is as follows: LAST WILL AND TESTAMENT KNOW ALL !vFN BY THESE PRESENTS THAT I, JOSEPH L. HANTZ, of the City of Chicago, County of Cook, and State of Illinois, at the age of seventy -seven years, being of sound and disposing mind and memory, do hereby make, declare and publish this to be my Last Will and Testament, hereby revoking all former Wills by me at any time made. As to my wordly estate, and all the property real, personal or mixed, of which I shall die possessed of, or to w1,_ich I shall be entitled to at the time of ray decease , I give, devise and bequeath in the manner following, to -wit: FIRST: It is my will that all my just debts and funeral expenses shall, by my executrix hereinafter named, be paid out of my estate as soon after'my decease as shall by her be found convenient. SECOND: I give, devise and bequeath all the rest,residue and remAinder of my .estate, real, personal and mixed of which I shall die possessed of, or to which I shall be entitled to at the time of my decease to my daughter FFUkNCES WAGNER, wife of HAROLD WAGNER, of Chicago, Illinois as and for her own property. THIRD : - I Will and Ordain that the Executrix of this, My Last Will and testament, be and is author- ized after my death to sell any part of or all of my real estate and convey said lands to any per- son or persons in fee simple, either at public or private sale, and also to execute any and all deeds to give proper conveyance of the same. I authorize ray Executrix hereinafter named to execute any bills of sale for any personal property or chattels that I may have at the time of my death. LASTLY : - I do nominate a-,-td appoint my beloved daughter, FRANCES WAGNER, to be the solelExecutrix of this my Last Will and Testament, without bond, for her faithful performance as such Executrix. IN WITNESS WHEREOF, I, the said JOSEPH L. HANTZ, have to this my Last Will and Testament subscribed my hand and-affixed my seal, this Twenty -Fifth Day of April A.D. One Thousand Nine Hundred and Thirty - Six (1936).
