<br />FINAL DECREE: IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA
<br />IN THE MATTER OF THE ESTATE OF )

<br />FERDINAND GUS PETERS,DECEASED )
<br />At a session of the County Court held in and for Hall County,Nebraska,the 11th day of August,1937,
<br />there being present Paul N.Kirk,County Judge.
<br />Be it remembered,that on the 15th day of July,1937,Herman C.Peters,as administrator of the estate
<br />of Ferdinand Gus Peters,deceased, filed in this court his final accounting as such administrator
<br />and a petition that said account be allowed,for a decree of heirship and a final settlement herein
<br />and his discharge,
<br />For these purposes,the 11th day of August,19370at 10 o'clock A.M.at the County Court Room in said
<br />County,was assigned as the time and place for hearing said petition,examining and allowing said
<br />account;that it was ordered that notice of the pendency of said petition be given to all persons
<br />interested in said estate by publishing a notice of said order in the Grand Island Independent,
<br />a legal newspaper published and circulated in Hall County,Nebraska,three successive creeks prior
<br />to said day of hearing,and it appears by proof on file that said notice was given as ordered by
<br />the Court.
<br />Upon an examination of the record and the evidence in this matter and being duly advised in the
<br />premises,the Court finds as follows: First :That Ferdinand Gus Peters departed this life on the
<br />5th day of January3,1937,in Grand Island,Hall County,Nebraska, intestate, and at the time of his
<br />death he was a resident of Hall County,Nebraska,and that said deceased left no last will and test-
<br />ament.
<br />Second: That on the 20th day of February,1937,John Fred Peters and Herman C.Peters,brothers of
<br />said Ferdinand Gus Peters,deceased,filed in this Court a petition praying for the appointment of
<br />Herman C.Peters as administrator of the estate of said deceased;that on the 20th day of February,
<br />1937 :an order of this court was made therein,assigning the 16th day of March,1937,at 10 o'clock
<br />A.M.at the County Court Room in said County as the time and place for hearing said petition and
<br />ordering that notice be given to all persons interested in said matter by publishing a notice of
<br />said order in the Grand Island Independent,a legal newspaper printed in said county,for three
<br />successive weeks prior to said day of hearing and it appears by proof on file that notice of said
<br />hearing was given as ordered by this Court.
<br />Third: The Court further finds that Herman C.Peters named in said petition was,upon his giving
<br />bond in the sum of $500.00,as ordered by this Court,appointed administrator as prayed;the Cpurt
<br />further finds that the deceased at the time of his death was a resident of Hall County,i'ebraska,
<br />and that he left the following heirs at law;Herman C.Peters and John Fred Peters,brothers,both
<br />over the age of 21 years.
<br />Fourth: That on the 17th day of March,1937,an order of this court was made allowing creditors three
<br />months in which to file their claims against said estate and the administrator one year in which
<br />to settle said estate,from the 13th day of April,1937,and further ordering that a notice of the
<br />same be published in the Grand Island Independent,a legal newspaper published and circulated in
<br />Hall County,Nebraska,three successive weeks prior to said 13th day of July,1937,and it appears
<br />by proof on file that notice of said order was published as ordered by this Court.
<br />Fifth: The Court further finds that on the 17th day of Mareh,1937,the said Herman C.Peters as
<br />administrator filed in Court his inventory of the property of said estate,and that according to
<br />said inventory,the deceased died seized and possessed of the following described property, to -wit:
<br />An undivided one -half interest in-
<br />A piece or parcel of land described as follows,to -wit: Commencing at a point Sixty -six (66) feet
<br />west of the northeasterly corner of Block Eleven (11) in Windolph's Addition to Grand Island,
<br />Nebraska,thence from said point,being in the northerly boundary line of said Block Eleven,along
