<br /> KNOW ALL MEN BY THESE PRESENTS THAT:
<br /> WHEREAS, in an action of partition pending in the District Court of Hall
<br /> County, Nebraska, where Gladys M. Schwieger and others were plaintiffs and Madge
<br /> Likes and others were defendants for the partition of certain real estate herein-
<br /> after described, the undersigned referee was appointed by the said Court to make
<br /> partition of the real estate and made a report in writing duly signed that parti-
<br /> tion of said lands could not be made without prejudice to the owners and the
<br /> Court examined and confirmed the report and made an order directing the referee
<br /> to sell the said real estate at public auction on June 25, 1963, at the Hall
<br /> County Courthouse in Grand Island, Nebraska.
<br /> ,Pursuant to such order I caused a notice to be published in the Grand
<br /> Island Daily Independent, a newspaper printed and of general circulation in and
<br /> about Hall County, Nebraska, which notice stated that I would offer the said real
<br /> estate for sale at public auction inside the north front ground-level door of the
<br /> Hall County Courthouse, Grand Island, Nebraska, on June 25, 1963, commencing at
<br /> 1:30 P.M. and this notice was published in the said newspaper on May 14, 1963,
<br /> May 21, 196�, May 28, 1963, June 4, 1963, and June 11, 1963, and on June 25, 1963,
<br /> I offered the said real estate, to-wit:
<br /> The West Half of the Southeast Quarter of Section Eleven,
<br /> Township 10 North, Range 11 West of the Sixth Prime Meridian, except
<br /> � 3 `' that portion used for railroad and highway purposes, riall County,
<br /> Nebraska,
<br /> ' ' / ,,-�-, The East Half of the Northwest Quarter of Section Fourteen,
<br /> 7 1 5 7 . Township 10 North, Range 11 West of the Sixth Prime Meridian, except
<br /> � for the portion used for railroad and highway purposes, Hall County,

<br /> , � ,,,;� ; for sale at public auction and sold the same to N!. D. DeVore, whose real name is
<br /> Maurice D. DeVore, for the sum of Fifty-Seven Thousand Five Hundred Forty-six
<br /> l` Dollars and ninety cents (�57,546.90), he being the highest bidder thereon. On
<br /> �� ,
<br /> August 21, 1963, the Court approved and confirmed the sale and directed me as
<br /> referee to execute a deed conveying the said real estate to the said M. D. DeVore,
<br /> �;
<br /> whose reai name is Maurice D. DeVore, in fee simple.
<br /> �» oo� � NOW, THEREFORE, I, Chesley S. Baker, referee, in consideration of the
<br /> � ' premises and the sum of Fifty Seven Thousand Five Hundred Forty-six Dollars and
<br /> �+�'-" ` "" ' ' ninety cents ($57,546.90) so bid and paid by M. D. DeVore, whose real name is
<br /> � � Maurice D. DeVore, do by virtue of the powers vested in me by law hereby grant,
<br /> sell and convey to Maurice D. DeVore and Helen L. DeVore as joint tenants with
<br /> the right of survivorship and not as tenants in corrunon with the express intent
<br /> � that the survivor shall take all of the real estat� upon the death of the other
<br /> � 6� as sole owner and to their heirs, successors and assigns the real estate
<br /> described as follows:
