Schwieger and others were plaintiffs and Madge , <br /> '' Likes and others were defendants tor the partition of certain real estate herein- <br /> after described, the undersigned referee was `appointed by the said Gourt to make <br /> partition of the said real estate and made a report in writing duly signed that <br /> partition of said lands could not be made without prejud3.ce to the owners and the <br /> Court examined and confirmed the report and made an order directing the referee <br /> to sell the said real estate at public auction on June 25, 1963, at the Ha1.1 <br /> . .� <br /> ' County Courthouse in Grand Island, Nebraska. <br /> ; Pursuant to such order I caused a notice to be published in the Grand <br /> < Island Daily Independent, a newspaper printed and of general circulation in and <br /> �; about Hall County, Nebraska, that I would offer the said real estate for sale at <br /> public auction inside the north front ground-level door of the Hall County Court- <br /> __z, � house on June 25, 1963, commencing at 1:30 P.M, and this notice wes published in <br /> ` <' the said newspaper on May 14, 1963, May 21, 1963, May 28, 1963, June 4, 1963, and <br /> '� , June 11, 1963, and on June 25, 1963, I offered the said real estate, to-wit: <br /> � � � <br /> �` The South Half of the South Half of Section Nine, Township 10 <br /> � ,, ; ; North, Range 11 West of the Sixth Prime Meridian, Hall County, Nebraska, <br /> � <br /> � <br /> for sale at public auction and sold the same to Ronald M. Shonka, he being the <br /> highest bidder therefor. And afterwards an assignment was filed by Ronald M. <br /> Shonka assigning his bid and interest to Dobesh Farms, Inc., and on August 20, <br /> 1963, the matter came on for further hearing on the report of the referee and <br /> � � �� upon objections filed by the plaintiffs to the confirmation of the referee's sale <br /> �°`' ' as regards the said real estate by virtue of the substantial increase over the <br /> ' ' � �. highest bid received by the referee. Piaintiffs were directed to make their maxi- <br /> mum bid in open court by the Honorable Donald H. Weaver, District Judge, and the <br /> assignee, Dobesh Farms, Inc., was given an opportunity to equal the bid and on <br /> August 21, 1963, further hearing was had and the assignee, Dobesh Farms, Inc., <br /> did equal the bid of Five Hundred Dollars (�500.00) per acre or Eighty Thousand <br /> Dollars ($80,000.00) and was accepted by the Court and the said sale was approved <br /> and confirmed by the Court on August 21, 1963, and the Court by order directed me <br /> as referee to execute to Dobesh Farms, Inc., a deed in fee simple to the said <br /> real estate. <br /> NOW, THEREFORE, I, Chesley S. Baker, referee, in consideration of the <br /> premises and the sum of Eighty Thousand Dollars (�80,000,00) so bid and paid by <br /> the Dobesh Farms, Inc., and by virtue of the powers vested in me by law, do by <br /> these presents grant, sell and convey unto the said Dobesh Farms, Inc., its: successo� <br /> and assigns the real estate described as follows: <br /> The South Half of the South Half of Section Nine, Township 10 <br /> North, Range 11 West of the Sixth Prime Meridian, Hall County, Nebraska, <br /> with all the appurtenances belonging thereto, to have and to hold to it, the <br /> said Dobesh Farms, Inc., and its heirs, successors and assigns forever, in fee simple <br /> 1963.
