' �, ; � � <br /> REFEREE'S DEED <br /> KNOW ALL MEN BY THESE PRESENTS: That whereas in an action <br /> in partition pending in the District Court of York Cour�y, Nebraska, being <br /> Case No. 1008? wherein Bernard Due and Orpha E. Davis Due are Plaintiffs <br /> and John Due et al, are Defendants for the partition of the following described <br /> real estate and other land described in the Petition of the Plaintiffs. I, the <br /> undersigned Ray L. Svehla, appointed to make partition thereof made a re- <br /> port in writing duly signed by me as Referee setting forth that the real estate <br /> sought to be partitioned could not be partitioned in kind without great loss and <br /> prejudice to the owners thereof, which said report was duly examined by the <br /> Court and the Court being fully advised in the matter thereupon approved the <br /> same and on September 25, 1962, entered an order directing me as Referee <br /> to sell the land thus sought to be partitioned in this action under the following <br /> terms, to-wit: At public sale for cash as upon execution. I was further directed <br /> to accept 15% of the purchase price at the time of sale with the balance to be <br /> paid in cash upon confirmation of the sale by the Court. <br /> In pursuance of said order, I caused a notice to be published in the <br /> Grand Island Independent, a daily newspaper printed and published at Grand <br /> Island, Nebraska and gene�'ally circulated in Hall County, Nebraska, that I <br /> would offer the real estate hereinafter described for sale at public auction at <br /> the County Court House in Grand Island, Nebraska on November 8, 1962 at 2 <br /> o'clock P.1VI. of said day, That at the time and place stated in said published <br /> notice and after it had been published for more than thirty days, I offered said <br /> ; <br /> land for sale at public auction and after holding said sale open for more than <br /> one hour, I sold the following described real estate, to-wit: <br /> "The 1Vorth Half of the Southeast Quarter (NZSE4) of Section Nineteen <br /> (19), Township Eleven (11) North, R,ange Eleven (11), West of the 6th P.
