<br /> Exhibit B to conveyance by Elaine Collier, et. al. to Elmer D. Stelk,
<br /> of a part of S� of S� of Sec. 14, T 11 N, R 9 W 6th P.M.
<br /> The covenants, conditions and restrictions running with the land
<br /> for the time hereinafter set out as made a part by ref erence and
<br /> attachment to the foregoing conveyance are as follows:
<br /> (1) Such tract shall be used for residential and no �ther
<br /> purpose.
<br /> (2) No dwelling shall be erected for occupancy thereof for more
<br /> than one family, nor shall any dwelling be used for occupancy for
<br /> more than one family.
<br /> (3) The ground floor area of the main structure of such dwelling,
<br /> exclusive of o en porches and garage, shall not be less than the
<br /> following: (a� For a one-story house not less than one thousand (1000)
<br /> square feet; or a one and one-half story house or a two-story house,
<br /> not less than a ground floor area of seven hundred twenty feet (?20�) .
<br /> (4) All frame buildings other than the main structure shall have
<br /> the same quality of outside wall finish and roof as that used for the
<br /> dwelling house.
<br /> (5) No building shall be constructed with unsightly materials,
<br /> boxes or salvage lumber; no building or dwelling house shall be moved
<br /> onto such tract of land; no trailer, �ent, garage, shack, or other
<br /> unsightly building, or out building shall be used upon such tract
<br /> as a residence or dwelling.
<br /> (6) No sod, eazth, sand, gravel or trees shall be removed from
<br /> such tract to the injury of the value or the appearance thereof, and
<br /> no unused building material, junk or rubbish shall be left exposed
<br /> on such tract except during actual building operations thereon.
<br /> (7) No cesspool shall be constructed, installed or maintained
<br /> or permitted in or upon such tract, no foul waste water or refuse or
<br /> garbage or sewerage of any kind shall be permitted to be disposed of
<br /> in or upon the soil or sand of such tract; all sewerage shall be con-
<br /> ducted through pipes or wholly enclosed drains to an adequate and
<br /> efficient septic tank or chemical disposal receptacle shall not be
<br /> closer than twenty-five feet (25�) to any line of such tract; and any
<br /> disposal system must be inspected and approved by the Departmen� of
<br /> Health of the State of Nebraska.
<br /> (8) No worn out or discarded automobiles, machinery or parts
<br /> thereof, shall be stored on such tract and no part thereof shall be
<br /> used for discarded automobiles, machinery, junk piles, or other
<br /> stora e of any kind of junk or waste material.
<br /> �9) No maufacture of any sort, or storage of material, or
<br /> activity of an offensive, dangerous noxious or odorous nature, sha11
<br /> be permitted, operated, or conducted upon such tract.
<br /> (10) The foregoing covenants, restrictions and conditions are
<br /> to run with such lands and shall be binding upon all persons and a11
<br /> parties claiming ownership thereof until January 1, 1992.
<br /> (11) If any owner of any lot, or his, her, their heirs or
<br /> assigns, shall violate or attempt to violate any of the covenants,
<br /> restrictions or conditions herein set forth, it shall be lawful
<br /> for any other person or persons owning any real estate in said
<br /> subdivision to prosecute any proceedings at law or in equity against
<br /> the person or persons violating or attempting to violate any such
<br /> covenants, restrictions or conditions, and to prevent him from so
<br /> doing or to recover damages for such violation, Provided, that a
<br /> breach of any such conditions, restrictions, or reservations shall
<br /> not defeat or render invalid the lien of any mortgage made in good
<br /> faith for value as to any such lot, and, Provided, further, that
<br /> such conditions, restrictions and reservations shall remain at
<br /> a11 times in full �orce and effect as against any owner of any
<br /> lot for reason of any breach thereof by any such owner, whether
<br /> acquired by purchase, foreclosure, devise, inheritance, or any
<br /> other manner, and Provided, further, that should any one or more
<br /> of any such conditions, restrictions or reservations be dec�ared
<br /> invalid, by a court of competent jurisdiction, the covenants,
<br /> restrictions or conditions shall not be affected, but shall con-
<br /> tinue in full force and eff ect.
