<br /> EXHIBIT "A" TO CONVEYANCE by Elmer Hann and Hazel Hann to Charles M.
<br /> Stewart and Florence F. Stewart as Joint Tenants of a part of NW4NE4, Section
<br /> 29, T11N, R9W.

<br /> # � The covenants, conditians and restrictions running with the land for the time
<br /> �' hereinafter set out, as made a part by reference and attached to the foregoing
<br /> conveyance, are as follows:
<br /> (1) Neither the tract herein conveyed, nor any part thereof, shall be
<br /> used for any purpose prohibited by SECTION V, "A" "Business District Re-
<br /> '�,• gulations" of Zoning Ordinance No. 2162 of the City of Grand Island, Nebraska, '
<br /> as passed and approved December 17, 1947, Provided, the Purchasers, and the
<br /> survivor of them, personally may temporarily make any use of the tract being
<br /> sold and purchased which wiil not permanently prevent compliance with such
<br /> � SECTION V, "A" "Business District Regulations".
<br /> (2) The ground floor area of the main structure of any dwelling house,
<br /> exelusive of open porches and garage, shall not be less than One Thousand
<br /> � (1000')' square feet.
<br /> (3} No build,ing shall be constructed with unsightly materials, boxes
<br /> �, ' or salvage lurnber; no buitding or dweliing house shall be moved onto such
<br /> � tract of land; no trailer, tent, garage, shack or other unsightly building, or
<br /> out building, shall be used upon such tract as a residence.
<br /> (4) No unsightly,building materials, junk or rubbish shall be left exposed
<br /> on such tract except during actual buitding operations.
<br /> (5) No foul waste water or refuse or garbage or sewage of any kind sha11
<br /> be perm.itted to be disposed of upon the.top soil of such tract. All sewage shall
<br /> be conducted through pipes or wholly enclosed drains to an adequate and efficient
<br /> septic tank or chemical disposai receptacle which shall not be closer than twenty-
<br /> five (25') feet to any lot line of the tract on which it is installed.
<br /> (6) No worn-out, discarded automobiles, machinery or parts thereof,
<br /> shall be stored on such'tract and no part'thereof shall be used for discarded
<br /> autom.obiles, xnachinery, junk piles, or other storage of any kind of junk or
<br /> waste :m:aterial, unless used for "fill!' and adequately covered by soil.
<br /> (7) The foregoing covenants, restrictions and conditions are to run
<br /> with such lands and shall be binding upon ail persons and all parties claiming
<br /> �ownership thereof until January 1, ,1970,
<br /> (8) If any owner of any Tot, or his, her or their heirs or assigns, shall
<br /> violate or attempt to violate any of the covenants, restrictions or conditions
<br /> herein set forth, it-shall be lawful for any other person or persons owning any
<br /> real estate in said tract to prqsecute any proceedings at law or in equity against
<br /> the person or persons violating or attempting to violate any such covenants,
<br /> restrictions or conditions, and to preverit him from so doing or to recover dam-
<br /> ages for such violation; Provided, that a breach �f any such conditions, restrictions
<br /> or reservations shall not defeat or render invalid the lien �of any m.ortgage made
<br /> in good faith for value as 'to any such lot, and, Provided, further, that such cfln-
<br /> ditions, restrictions and xeservations shall remain at all times in full force and
<br /> effect as against any �owner �f any 1ot for reason of any breach thereof by any
<br /> such owner, whethe:r acquired by purchase, foreelosure, devise, inheritance, or
<br /> any other manner, and Pr:�ovided, further, that should any one or more of any such
<br /> conditions, restrictions �or reservati�ons be declared invalid, by a court �f com-
<br /> petent jurisdiction, the covenants, restrictions, or c�onditions shall not be affected,
<br /> but shall continue,in fu11 f�rce and effect. -
