<br /> Judicial Distr'ict of the State of Nebraska, within and for the County of Hall
<br /> � wherein The..�County of Hall Nebraska, is plaintiff and Thomas Forrest Concannon
<br /> f and Concannon, his wife; et al., are defendants, No. J�2, Doc. l
<br /> Page��, the plaintiff did on the 3rd day of April, 19b2, obtain a decree
<br /> 'i finding there to be due from the defendants for general and special improvement
<br /> � ' ; taxes u�5on a Certificate of Tax Sale and subsequent taxes, in �auses of Action
<br /> No. 2 and 3, the sums of $260.03, accruing interest and costs of the suit, and there
<br /> is due the cross petitioners from the defendants, the amounts of $351.07 and $348•36
<br /> and accruing interest, and whereas, it was then and there further ordered in the
<br /> said action that in default of the payment of the sum so found due from the
<br /> said defendants that the Sheriff of said County of Hall should cause the lands
<br /> and tenements hereinafter described to be advertised and sold according to law
<br /> to pay� the same� and� whereas, default having been made therein, the said Sheriff
<br /> of said County, under and by virtue of the said decree and the order of Sale to
<br /> him duly directed, did, on the 1l�th day of August, 1962, at the north door of the
<br /> Court House in the City of urand Island, in said County of Hall, having first
<br /> given due and legal notice of the time and place of said sale for not less than
<br /> thirty days prior thereto in the Grand Island Daily Independent, a legal newspaper,
<br /> printed and in general circulation in said County of Hall, sell said premises at
<br /> public auction to Homer B. Rupert and Doras E. Rupert, husband and wife, as joint
<br /> tenants with survivorship and not as tenants in common; for the sum of Eight
<br /> hundred fifty and no/100 ($850.00)- - - - - - - - " � - - - - - Dollars,
<br /> (the total accrued costs of suit and sale being $110.59), which sale was afterwards
<br /> on the 5th day of October , 1962, examined and conri-rm:�d by the said Court �nd
<br /> the said E. H. Stobbe as such Sheriff, ordered to convey the said premises in i'ee
<br /> simple to the said Homer B. Rupert and Doras E. Rupert, husband and wife.
<br /> NOW� THEREFORE� I� the said Sheriff of the County of Hall, as aforesaid,
<br /> in consideration of the premises and by virtue of the powers vested in me b�r law
<br /> and the decree of said Court, do herepy give, grant, and convey to the said
<br /> Homer B. Rupert and Doras E. Rupert, husband and wife,
<br /> heirs and assigns, the premises so as aforesaid sold, to-wit:
<br /> Lots Ten (10) and Eleven (11) in Block One (1) in Harrison�s
<br /> Subdivision of the Southwest Quarter (SW4) of the Southeast
<br /> Quarter (SE4) of Section Eight (8) in Township Eleven (11)
<br /> No�th, Range Nine (9) West of the 6th P.M., Hall County,
<br /> Nebraska, as surveyed, platted and recorded,
<br /> with the appurtenances.
<br /> IT BEING THE INTENTION OF ALL PARTIES HERETO, THAT IN THE EVENT OF THE
<br /> DEATH OF EITHER OF SAID GRANTEES, THE ENTIRE FEE SIMPLE TITLE TO THE REAL ESTATE
<br /> DESCRIBED HEREIN SHALL VEST IN THE SURVIVING GRANTEE.
<br /> TO HAVE AND TO HOLD THE SAME unto the said Homer B. Rupert and Doras E.
<br /> Rupert, husband and wife, as joint tenants with survivorship and not as tenants
<br /> in common, and their heirs and assigns forever.
