<br /> THIS DEED, made this 21st day of July, 1962, by a�d between Robert Larson, Admin-
<br /> istrator with the wi11 annexed under the last will and testament of Fred H. Harder,
<br /> Deceased� party of the first part� and Marcus B. Diffendaffer and Frieda E. Diffendaffer,
<br /> spouse of each other, as joint tenants and not as tenants in common, parties of the
<br /> second part;
<br /> WITNESSETH: That the party of the first part, the duly appointed, qualified and
<br /> acting Administrator with the will annexed under the i�st �.i1 and testament of-Fred
<br /> H. H arder� Deceased, which instrument is of record in the office of the County Court
<br /> of Hall County� Nebraska, by virtue of the power and authority granted and conferred
<br /> upon him under said wi11 and in consideration of the sum of One Thousand Three Huncired
<br /> Dollars ($1,300.00) to him paid by parties of the second part, the receipt wYe reof
<br /> is hereby aclm owledged� does by these presents grant, bargain, se11, convey and con-
<br /> firm unto parties of tl7e second part, as joint tenants, and to their assigns, and to
<br /> the heirs and assigns of the survivor as between them, the following described real
<br /> estate located in Ha11 County, Nebraska, to wit:
<br /> Lot Twelve (12)� in Block Three (3), Fifth Addition to the
<br /> Town of Cairo, Ha11 County, Nebraska�
<br /> together with all the tenements, hereditaments and appurtenances unto the same belong-
<br /> ing or otherwise appertaining; and a15o all the estate, right, title, interest, pro-
<br /> perty� possession, claim and demand whatsoever which the said testator had in his
<br /> lifetime, and at the time of his death, a.nd which the said party of the first part
<br /> has by virtue of the last will and testament or otherwise of, in or to the above
<br /> grarited premises.
<br /> TO HAVE AND TO HOI�D the said premises aforesaid with the hereditament:, =:nd
<br /> appurtenances thereof unto the parties of the second part and their assigns and to
<br /> the heirs and assigns of the surv.i.vor as between them, forever.
<br /> And the said party of the fi.rst part, for himself� his heirs, executors and admin-
<br /> istrators does covenant� promise and undertake to and witYa the said parties of the
<br /> second part, t.11eir assigns, and the heixs and assigns of the survivor as between them,
<br /> that he is Iawfully the administrator wi.th the w ill annexed under the last wi11 and
<br /> testament of said Fred H. Harder, Deceased, and has power to convey as aforesaid_,
<br /> and has in all respects acted in making this conveyance, in pursuance to the author-
<br /> ity granted by the said l,ast will and te�tament of Fred H. Harder, Deceased; and
<br /> that he has not made, done or suffered any act, matter or thing whatsoever since
<br /> he was appointed administrator with the will annexed, whereby the above granted
<br /> premises, or any part thereof, are, sha11 or may be impeached, char�ed or encumbered
<br /> in any maY�ner whatsoever and that he is lawfully seized of said premises.
