That said petitioner <br />at the time of the filing of said petition herein, was the owner of an estate of inheritance in <br />said real estate, above described, and was a proper and competent person to prosecute this proceeding; <br />That more than two years had elapsed since the death of said Edith L.Porter before the filing of s id <br />petition; that no application has been made in the state of Nebraska for the appointment of an ad- <br />ministrator for the estate of the deceased; That the funeral expenses and all debts of said deceas d <br />have been fully pa'.d, and if any debts exist against the estate of said deceased, the same have long <br />since been barred by the statute of limitations of the State of Nebraska; the court further finds <br />that on the 27th day of October 1922, the said Wallace E.Porter and his then wife, Nona Florence <br />Porter, made, executed and delivered their certain quit -claim deed to the petitioner herein, convek- <br />ing all their interest in and to said Lot Two (2) in Block Eight (8), which said deed was duly fil�d <br />for record and recorded on November 7th, 1922, in Book 61 at Page 125 of the Deed Records of Hall <br />County, Nebraska. <br />It is therefore ordered, adjudged and decreed by the court, that Edith L.Forter died intestate on <br />the 30th day of August 190+; that at the time of her death she was a resident and-inhabitant of sa <br />d <br />Hall County, Nebraska; that she left surviving her as her sole and. only heirs at law Wallace E.Por <br />er <br />her husband, and the petitioner, Eugene Thompson Porter, her son; that the degree of kinship of sa <br />d <br />heirs to the deceased is that of husband and child as respectively stated above; that at the time <br />of her death the deceased was seized of an estate of inheritance and was the owner in fee simple of <br />Lot Two (2) Block Eight (8) of the original town, now city, of Grand Island,Nebraska, and that her <br />said estate passed and descended on her death as follows; To her said husband, Wallace E.Porter, a <br />courtesy interest therein, and in fee to her said son, Eugene Thompson Porter. That the petitioner <br />at the time of the filing of his petition was the owner of an estate of inheritance in said above <br />described property, and was a proper and competent person to prosecute this proceeding; that more <br />than two years had elapsed since the death of said Edith L.Porter before the time of the filing of <br />said petition; that no application has been made in the State of Nebraska, for the appointment of <br />an administrator of the estate of the deceased, either by her heirs or by persons claiming to be <br />creditors of said deceased; That the funeral expenses and all debts of said deceased have been fully <br />paid; that the cost of this proceeding have been fully paid; and that the estate of said deceased <br />is not subject to federal or State Inheritance taxes. <br />IT IS FURTHER ORDERED, adjudged and decreed by the court, that all debts of said Edith L.Porter, <br />if any such exist, are forever barred and precluded; that the said Wallace E.Porter, husband of th <br />deceased, have and take a courtesy interest in,and to said real property, hereinbefore described, <br />and that the petitioner Eugene Thompson Porter, only child of the deceased, have and take a fee <br />simple title in and to said real property, hereinbefore described, subject only to the courtesy <br />interest therein of said Wallace E.Porter, and that the estate of said Edith L.Porter is hereby <br />forever settled and closed.
