<br />6. That on the 17th day of June, 1929, an order was duly entered by the Court fixing the 19th day
<br />of July 1929, and the 19th day of October,- 1929, at 10 o'clock A.M., at the County Court room in
<br />said County, as the time and place for hearing, adjustment and allowance of claims against said
<br />estate, and that all claims not filed on or before October 19th, 1929, should be forever barred,
<br />and directing that notice thereof be given by publication in the Hastings Daily Tribune for four
<br />successive weeks prior to July 19th,1929; that thereupon such notice to creditors was duly given
<br />and published as required by law and in compliance with °ithe order of this Court.
<br />7. The Court further finds that the time for filing claims has long since expired and that no clal
<br />has been filed against said estate, and that the costs of administration have been fully paid; and
<br />IT IS HEREBY ORDERED AND ADJUDGED that all claims not filed against said estate are forever barred
<br />8. That said Charles X.Miller, executor, submitted his account and no one appearing to object ther to
<br />for contest the sane, the Court finds that said account is ju=t and true and should be and is hereb_
<br />allowed and approved and ordered recorded as his final account.
<br />9. The Court further finds that said Ella L.Miller, was at the time of her deceased, a widow, and
<br />that hhe left surviving her as here only heirs at law, devisees and legatees under the will and
<br />persons interested in said estate, the following named persons, to -wit:
<br />Mabel B.Rainforth, daughter, Doniphan, Nebraska.
<br />Charles X.Miller, Son, Doniphan, Nebraska;
<br />Arthur H.Miller, Son, Doniphan, Nebraska;
<br />Benton L.Miller, Son, Hastings, Nebraska:
<br />Roland P.Britt, Grandson, Hastings, Nebraska; and
<br />that said grandson was the sole issue of a deceased daughter of said Ella L.Miller, deceased; and
<br />said Ella L.Miller left no other child or children, nor the issue of any deceased child her surviv-
<br />ing except said one grandson; that all of the above named heirs are of legal age and past their
<br />ority, except the said grandson Roland P.Britt..
<br />0. The Court further finds that all of the personal property of the said Ella L.Miller, deceased,
<br />as bybheV1 *ill bequeathed to her husband, Aaron Miller; and that said Aaron Miller died on the 28t
<br />ay of September, 1926, by reason of which the said personal prperty goes to the heirs of the said
<br />aron Miller; that no change in the heirs of said Aaron Miller has taken place since the date of
<br />is death, and that the heirs of the said Aaron Miller and the heirs of the said Ella L.Miller are
<br />deistical and the same, and consist of the aforesaid Mabel B.Rainforth,Charles X.Miller, Arthur H.
<br />iller, and Benton L.Miller, Children and Roland P.Britt, Grandson, and none other.
<br />1. The Court further finds that the said Ella L.Miller died seized in fee of the following descrit
<br />eal estate, to -wit:
<br />he.undivided one half of the northwest quarter of Section thirty -two, town nine, north, Range ten
<br />est, of the sixth principal meridian, in Hall County, Nebraska,
<br />that the personal assets of this estate, now in the hands of the executor, consist of a cash
<br />ante of $2109.95, and of all of the furniture owned by the said Ella L.Miller, at the time of
<br />ease, except a part thereof that was sold for $25.00.

<br />2. The Court further finds that by the terms of said Will the said Arthur H.Miller, son, is entitled
<br />n fee to
<br />undivided half of the east half of the northwest quarter of section thirty- two,in town nine,
<br />th, range ten west of the sixth principal meridian, in Hall County, Nebraska;
<br />t the said Mabel B.Rainforth, daughter, is entitle4,, in fee, to
<br />the undivided half of the West half of the northwest quarter of section thirty- two,in town nine,
<br />north, range,ten west of the sixth principal meridian, in Hall County, Nebraska.
<br />3. The Court further finds that the said heirs of the said Aaron Miller and of the said Ella L.
<br />iller, to -wit: Mabel B.Rainforth, Charles X.Miller, Arthur H.Miller and Benton L.Miller, children,
<br />ad Roland P.Britt, Grandson, are each entitled to an undivided one fifth of the said furniture now
<br />in the hands of said executor, and are each ertitled to one fifth of said sum of $2109.95•
<br />4. The Court further finds that no inheritance tax is payable in said estate, and that the total
