<br />On this Ist day of July, 1937, this matter came on to be heard upon the petition of the administr
<br />for of the estate of the deceased, asking the instruction and authority of this court in' reference
<br />to the release by the administrator of the mortgage given by F.A.Tuffs and Mertie Tuffs, husband a

<br />wife, to W.A.Julian, (who was the same and identical person as William A.Julian the deceased herei:

<br />named) dated August 131 1927, recorded in Book 63, on page 494 of the real estate mortgage records
<br />fof Hall Counts, Nebraska, in which mortgage was described Lot 1, East Half of Lot 2, in Block 2,
<br />Dodd & Marshall's Ad- iition to the village of Wood River, Nebraska, and the appearance and answer
<br />iof Grace Julian and Marie Clearman, and the evidence and was submitted to the court, upon conciser
<br />ation whereof the court finds:
<br />That William A.Julian died intestate a resident of Adams County, Nebraska, on the 23rd day of
<br />January, 1929, and he left surviving him as his sole heirs at law and next of kin his wife Grace
<br />Julian and his daughter and only child Marie Clearman, each of whom were of legal age at the time
<br />ON
<br />of his death, and he left surviving him'no son, and no other daughter, nor the child of any deceased
<br />son or daughter.
<br />That the deceased was at the time of hiscbath the owner of the mortgage above described, recorded
<br />in Book 63 on page 494 of the real estate mortgage records of Hall County, Nebraska, in the offie
<br />of the register of deeds thereof, and four of the notes of $400.00 each, secured by said mortgage;
<br />that the fifth note secured by said mortgage in the sum of $400.00 was paid to the deceased prior
<br />to his death; that the indebtedness secured by said mortgage, and the mortgage was satisfied by an
<br />agreement and transaction between the makers of the mortgage, and Grace Julian and Marie Clearman
<br />subsequent to the death of the deceased by virtue of which the title to the premises covered by
<br />the mortgage was conveyed in fee simple to Grace Julian by deed dated November 12, 192% recorded
<br />in Book 68, page 629 of the deed records of Hall County, Nebraska, that said mortgage has not beer
<br />released of record, notwithstanding the fact that the iddebtedness secured thereby was satisfied
<br />and cancelled by the transaction above referred to; that each and all of the allegations of the
<br />petition of the administrator, and of the appearance and answer of Grace Julian and Marie Clearmar
<br />are true, and the administrator should be authorized and instructed by the court to execute and
<br />deliver a release of said mortgage, and to do and perform each and everything necessary and propr
<br />to fully discharge and release said mortgage upon the real estate mortgage records of Hall County,
<br />Nebraska, in the office of the register of deeds thereof.
