<br />has fully expired, and that all persons having claims against said estate, if any such there be,
<br />are forever barred and excluded from setting up or asserting any such claims against said estate.
<br />The Court further finds that the said Martha Ann Sutton died siezed as the owner in fee simple of
<br />the following described real estate in Hall County and State of Nebraska, to -wit: The Southwest
<br />quarter (Swi) of the Northeast Quarter (NE}) of Section Thirty -four (34),Township Nine (9) North,
<br />Range Nine (9) West of the 6th P.M. in Hall County, Nebraska.
<br />The Court further finds that the said Martha Ann Sutton, deceased, left surviving her as her only
<br />heirs at IA w the following named persons, to -wit: John Sutton, a brother; Eveline E.Stevenson, a
<br />sister; and Catharine Fitzsimmons, a sister; that the said Martha Ann Sutton, deceased, was never
<br />married, and that all of said heirs are of legal age.
<br />The Court further finds that by the terms and provisions of said Last Will and Testament of the
<br />said Martha Ann Sutton, deceased, the said premises descended as follows, to -wit: The Southwest
<br />Quarter of the Northeast Quarter (SWJNEJ) of Section Thirty -four (34),Township Nine (9) North,Rang
<br />Nine (9) West of the 6th P.M. in Hall County, Nebraska, to: John Sutton, Eveline E.Stevenson and
<br />Catharine Fitzsimmons, share and share alike.
<br />The Court further finds that a partition proceedings was commenced in the District Court of Hall
<br />County, Nebraska, in a case entitled "Eveline E.Stevenson, et al.,plaintiffs, vs. Catharine Fitz-
<br />simmons, et al, defendants, " -being case No. 5255, whereby the real estate hereinbefore described
<br />was partitioned and sold and that each of the legatees hereinbefore named hate been paid their
<br />proportionate interest in the proceeds derived from the sale of said premises; the Court further
<br />finds that the final report filed by the said executor, Jay A.Harding, of his doings and proceed-
<br />ings in the above estate is correct and is in all respects approved, and that there remains no
<br />money in his hands for distribution.
<br />The Court further finds that neither the said estate nor the share of any legatee is subject to ar
<br />inheritance tax.
<br />The Court further finds that the said executor has paid the funeral expenses of said deceased, th
<br />debts due against said estate, the costs of this proceedings, and all claims provided for in said
<br />Last Will and Testament; that.the said executor has performed all and singular every condition
<br />request contained in said Last Will and Testament of the said Martha Ann Sutton, deceased, and
<br />no money remains in his hands as such executor, and the said estate should be closed and the
<br />for discharged.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED by the Court that the final report of the said Jay
<br />A.Harding, executor of the Last Will and Testament of the said Martha Ann Sutton, deceased, be anc
<br />the same is hereby approved and allowed as and for his final report, and said estate is hereby
<br />settled and closed and the executor discharged and his bond as such is hereby released.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that the real estate hereinbefore des-
<br />cribed, viz, the Southwest Quarter of the Northeast Quarter (SWJNEJ) of Section Thirty -four (34),
<br />Township Nine (9) North, Range Nine (9) West of the 6th P.M., under the terms and conditions of tY
<br />said Last will and Testament of Martha Ann Sutton, deceased, did pass and descend to John Sutton,
<br />Eveline E.Stevenson and Catharine Fitzsimmons, share and share alike.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that the said Jay A.Harding, executor, hF
<br />paid all claims, debts and expenses of administering said estate and there is nothing due and owir
<br />from said estate.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that the estate of Martha Ann Sutton, d
<br />ceased, be closed and the executor discharged and his bond cancelled.
