<br />land that under and by virtue of the laws of descent of the State of Nebraska said real estate passed
<br />and descended in absolute title to the above named heirs subject to the payment of the debts of th
<br />said George Sutton, deceased, and also subject to the costs and expenses of administering his estate.
<br />The Court further finds that there was insufficient money in the hands of the administrator to pay
<br />the debts allowed against said estate and the costs and expenses of administering same, that there
<br />upon he procured a license in the District Court of Hall County, Nebraska, in a case entitled "In
<br />The Matter Of The Application Of Jay A.Harding, Administrator Of the Estate Of George Sutton,De-
<br />ceased, For License To Sell Real Estate," being case No. 83379 and that by virtue of the license
<br />granted him by said Court he did sell Lot Five (5) and the East Ten (10) Feet of Lot Four (4) in
<br />Holme's Sub - Division of Lots Twenty -one (21), Twenty -two (22) and Twenty -three (23) of Kerr's Add-
<br />ition to the City of Hastings, Adams County, Nebraska, and that he has accounted for the money re-
<br />ceived from the sale of the said real estate.
<br />The Court further finds that a partition action was commenced in the District Court of Hall County
<br />Nebraska, in a case entitled " Eveline E.Stevenson, et al., plaintiffs, vs. Catharine Fitzsimmons,
<br />et al., defendants, "'being Case No. 5254, and that the said Jay A.Harding, administrator, received
<br />from the referee a one - eleventh (1 /11) amount of the proceeds derived from the sale of said real
<br />estate for costs and expenses, and that he has accounted for the money so received.
<br />The Court further finds that the final report filed by the said Jay A.Harding, administrator,
<br />shows that he has accounted for all of the moneys coming into his hands as such administrator; tha
<br />the costs and expenses of administering said estate have been paid in full, and that eighty (80)
<br />per cent of the amount of each claim allowed against said estate has been accepted by all persons
<br />having claims against said estate as settlement in full and that, therefore, all claims have been
<br />paid, and that there remains no money in the hands of said administrator for distribution amongst
<br />the respective heirs of the said George Sutton, deceased; that the Court finds that the said final
<br />report filed by said administrator is correct and is in all respects approved and that the said
<br />estate should be closed and the administrator discharged.
<br />The Court further finds that neither the said estate nor the share of any of the heirs is subject
<br />any inheritance tax.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED by the Court that the final report of Jay A.Hard-
<br />Ing, administrator of the estate of George Sutton, deceased, be and the same hereby is, in all
<br />things, approved and allowed as and for the final report of said administrator, and said estate is
<br />hereby settled and closed and said administrator discharged.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that all claims against said estate have
<br />been paid, that due and legal notice has been given to all persons of the time and place fixed by
<br />the Court for the filing of claims against said estate, and that the time fixed for filing claims
<br />has fully expired, and that all persons having claims against said estate, not filed herein, if
<br />any such there be, are forever barred, enjoined and excluded from setting up or asserting any such
<br />claims against said estate.
<br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED by the Court that under and by virtue of the laws of
<br />descent of the State of Nebraska the absolute title to the real estate hereinbefore described
<br />passed and descended to the following persons, and in the following named proportions, viz:
