<br />[that due and legal notice of the time and place of hearing upon said final account and petition
<br />for distribution has been given by publication as provided by law, that the said account is true
<br />and correct in all things, and should be approved and confirmed, by the Court.
<br />The Court further finds that Seward R.Benton died, intestate, on September 12, 1936, being a resi-
<br />dent and inhabitant of Hall County, Nebraska, that all proceedings have been had in the matter of
<br />said estate for the filing and allowance of claims, that a time and place for filing such claims
<br />has been duly fixed by order of the Court, and notice thereof given to all creditors and other
<br />persons interested therein, that said time has expired, that all claims filed and allowed have bee
<br />duly paid, that the claim of Cairo State Bank had been withdrawn, and that all claims, debts, and
<br />allowances of every kind and character, have been paid, and that the said administrator has on hand
<br />belonging to the said estate, the sum of $3651.451 as shown by said final account.
<br />The Court further finds that the said Seward R.Benton died seized of the following real estate in
<br />Hall County, Nebraska, to -wit: Lots Three (3) and Four (4), in Block Six (6) in the Original Townll
<br />of Cairo.
<br />The Court further finds that the said Seward R.Benton left, as his sole and only surviving heirs
<br />at law, Grace Benton, his widows Charles W.Benton, a son, and Jane Evelyn Benton, a minor daughter
<br />and that the said real and personal estate should be assigned and set over to the said heirs at 14
<br />in the proportions provided by law.
<br />IT IS, THEREFORE, ORDERED AND DECREED that the final account and petition for distribution of the
<br />said adminis':Tator be, and the same is hereby, approved and confirmed- that the said administrator
<br />pay the said balance in his hands to the heirs at law of said Seward R.Benton aforesaid in the fo11
<br />lowing proportions: one third to each of said heirs at law, and that upon said payment, the said
<br />administrator be discharged from his trust.
<br />IT IS FURTHER ORDERED AND DECREED that the real estate hereinbefore described be, and the same
<br />is hereby, assigned and distributed to the said heirs at law in the proportions provided by law,
<br />to -wit, an undivided one -third interest to each of said heirs at law, subject to the honestead
<br />therein of the said Grace Benton,

<br />remaining in said Court, that the same is a correct transcript thereof, and of the whole of such
<br />original record; that said Court is a Court of Record having a seal, which seal is hereto attached
<br />that said Court has no Clerk authorized to sign certificates in his own name, and that I am the
<br />legal custodian.of said Seal and of the Records of said Court, and that the foregoing attestation
<br />is in due .form of law.
