1 <br />1 <br />1 <br />1 <br />`655 <br />FINAL DECREE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />In the Matter of the Estate of ) <br />) FINAL DECREE <br />Arthur D.Baker, Dedeased ) <br />Now on this 23rd day of April, 1937, this cause came on for hearing upon the final report of <br />ti <br />Arthur B.Beindorff and Robert W.Beindorff, administrators of the estate of Arthur D.Baker, deceased, <br />and upon their petition for the Approval and allowance of said report, the settlement of said estate <br />and their discharge herein, and the Court having examined the records and files herein, and being <br />fully advised in the premises, finds that Arthur B.Beindorff and Robert W.Beindorff filed theirl <br />petition in this court on the 16th day of December, 19339 alleging among other things, that <br />D.Baker departed this life intestate on the 10th day of December, 1933, being at the time of his <br />death, a resident and inhabitant of said county and the owner of an estate to be administered, <br />situated in said county, and praying that Arthur B.Beindorff and Robert W.Beindorff, or some othei <br />suitable person be appointed administrator-of said estate; that upon the filing of said petition, <br />an order was entered herein, fixing the time and place for hearing the evidence in support of the <br />allegations set forth in said petition and giving notice thereof as provided by law; that said <br />hearing was held, as heretofore ordered by the Court, and the said Arthur B.Beindorff and Robert <br />W.Beindorff appointed administrators of said estate, and they thereupon filed their bond and re- <br />ceived letters of administration entitling them to administer the assets of said estate. <br />The Court further finds that due and legal notice has been given to all persons of the time and <br />place fixed by the Court for filing claims against said estate, and that all persons having claim <br />against said estate, not filed within the time fixed by the Court, if any such there be, are for- <br />ever barred, excluded and enjoined from setting up or asserting any such claims against said esta <br />The Court further finds that said deceased departed this life, leaving surviving him as his heirs <br />at law and only heirs at law and next of kin, the following described persons; Arthur B.Beindorff <br />• nephew, and Robert W.Beindorff, a nephew, being the sole surviving children of Emily W.Beindorf <br />• deceased sister of the said Arthur D.Baker; that the said Arthur D.Baker left a purported last <br />will and testament in which his wife Ella Mamie Baker was named as beneficiary and sole legatee <br />thereunder, but that she died previous to the death of Arthur D.Baker, and left no issue survivin <br />P <br />her, and therefore said will was revoked as provided by the laws of the state of Nebraska, and said <br />last will and testament has become null and void; and that the said Arthur D.Baker died intestate <br />The Court further finds that the said deceased was the owner of the following described property <br />In Hall County, Nebraska, to -wit: Lots Seventeen (17) and Eighteen (18) in Block Ten (10) Ashton <br />Place, an Addition to the City of Grand Island, Nebraska, and that said real estate did pass and <br />descend by virtue of the statutes of descent of the state of Nebraska, to Arthur B.Beindorff and <br />Robert W.Beindorff, share and share alike, in absolute title. <br />The Court further finds that said administrators have reduced all the personal property to cash <br />except the articles of personal property shown in the final report, which were divided according <br />to mutual agreement between the said Robert W.Beindorff and Arthur B.Beindorff; that they still <br />hold a claim against School District Number Two of Grand Island,Hall County, Nebraska, on which <br />there is now pending a suit in the District Court of Hall County, Nebraska, for the recovery of <br />the amount claimed due thereunder; that the amount received from all sources by said administrato s <br />was the sum of $10,856.24, and the amount of expense paid out was $11,327.19; that the sum of <br />$440.95 has heretofore been advanced by the said Robert W.Beindorff; that he makes no claim for <br />said sum against said estate and that said administrators have filed the final report herein, se <br />ting forth the items received and the items paid out; that due and legal notice has been given to <br />all persons of the time and place fixed by the court, for hearing upon @aid report; that no -one <br />
