M27 -5 -33 said estate, and she thereupon filed her bond and received letters of administration entitling her <br />to administer the assets of said estate. <br />The Court further finds that due and legal notice has been given to all persons of the time and <br />place fixed by the court for filing claims against said estate, and that all persons having claims <br />against said estate, not filed within the time fixed by the court, if any such there be, are forevf <br />red, excluded and enjoined from setting up or asserting any such claims against said estate. <br />The court further finds that said deceased departed this life, leaving surviving him as his heirs <br />jat law and next of kin and only heirs at law and persons entitled to share in his estate, the fo1- <br />x <br />lowing named persons, to -wit: Anna C.W.Tagge, surviving widow of said deceased, Arthur C.Tagge, <br />JAlbert H.Tagge, Arnold F.Tagge, Max J.Tagge, sons of the deceased; Dora C.Hitchler,Effilly S.Ewoldt, <br />EEdith M.Tagge, daughters of said deceased; that the said Claus J.Tagge had been married previously, <br />and that Anna C.W.Tagge was his second wife, and that she is not the mother of all of the above <br />children: that Claus J.Tagge was also known as Clause J.Tagge. <br />:r <br />ed <br />The court finds that said deceased died as the owner of the folldwing described real estate, to -wi *: <br />t Five (5) in Block Ten (10) in H.G.Clark's Addition to the City of Grand Island, <br />The Southwest quarter of Section Thirty -six (36)0 Township Twelve (12), North, Range Eleven (11), <br />West of the 6th P.M., in Hall County, Nebraska; <br />that lot five in block ten above described, was occupied by the deceased at the time of his death, <br />as his home; that said real estate did pass and descend by virtue of the statutes of descent of <br />the state of Nebraska, at the death of the said Claus J.Tagge as follows: one - fourth to Anna C.N. <br />Tagge, surviving widow, and the remaining three - fourths to his children, namely, Arthur C.Tagge, <br />Albert H.Tagge, Arnold F.Tagge, Max J.Tagge, Dora C.Hitchler,E.Wily S.Ewoldt, Edith M.Tagge, share <br />and share alike, subject, however, to the homestead rights of the said Anna C.W.Tagge in and to <br />t Five (5) in Block Ten (10) in H.G.Clark's Addition to the city of Grand Island. <br />The Court further finds that the Southwest quarter of Section Thirty -six (36) Township Twelve (12), <br />North, of Range Eleven (11)0 Hall County, Nebraska, was sold 'during the administration of said <br />estate to Gus Holling for the sum of Ninety -six hundred dollars ($9600.00) that all of the above <br />heirs joined in the conveyance of said property and that the purchase price received for said <br />property is included in the final report of the said Anna C.W.Tagge, filed herein; that the said <br />Gus Holling advanced sufficient funds to pay the mortgage indebtedness against said premises and <br />the claims allowed against said estate and expense of administration, and that under the agreement, <br />!the balance of said purchase price was to be paid upon delivery of an abstract of title to said <br />'premises showing a marketable title to said property in the heirs at law of Claus J.Tagge, decease l; <br />that the said administratiix has reduced the personal property to cash and that including the pur- <br />chase price of said farm, the total amount thereof is the sum of Ten thousand five hundred thirty <br />dollars and 31 /100 ($10,530.31); that the amount paid out by said administratiix as shown by said <br />report is the sum of Forty -two hundred forty -six and 68/100; that said sum does not include the sun <br />of Two hundred eight and 96/100 dollars (208.96) which was due said administratiix for widow's <br />allowance and interest advanced by her, and that her claim for said sum was approved by the court <br />on October 22, 1936; that said sum does not include the item of $6.75 interest charged on the <br />account of O'Loughlin- Livingston Company; and that said administratiix should have credit for said <br />sums, leaving a balance on hand in the sum of Four thousand thirty and 97/100 ($4030.97). <br />The court further finds that Max J.Tagge was indebted to said estate in the sum of One Hundred <br />seventy dollars (0170.00) and that Anna C.W.Tagge has advanced the sum of One Hundred seventy dol- <br />lars ($170.00) to take up said indebtedness, making a total amount in her hands for distribution <br />in the sum of Four thousand two hundred and 97/100 ($4,200.97). <br />The court further finds that said sum should be distributed as follows: <br />!one- fourth thereof to Anna C.W.Tagge <br />X3/28 to Arthur C.Tagge <br />q_411/29_ to Dora f <br />ep­_ <br />j3/28 to Albert H.Tagge, <br />$1050.24 <br />450.10 <br />1, .-A 1 A <br />0.10 <br />
