<br />Ithereupon said Augusta Stuhr filed her bond and took the oath of offioe,which bond was approved
<br />by this Court and Letters Testamentary issued to said executrix.
<br />That on said 22nd day of September,1936,this Court made an order giving notice to creditors herei ,
<br />providing that all creditors of said deceased be allowed three months from the 13th day of October,
<br />19361in which to file claims with proof thereof for examination and allowance,and that all claims
<br />outstanding,not so f iled,shall be forever barred.Said notice was published,in three consecutive
<br />issues in said Central City Republican in compliance with said order,proof thereof being on file
<br />in this office.
<br />THE COURT FURTHER FINDS that all claims filed against said estate have been paid and satisfied.
<br />THE COURT FURTHER FINDS that the deceased was seised in fee simple of The Northeast Quarter (N*)
<br />of Section Twenty -eight (215), Township Thirteen (13) North,Range Seven (7) West 6 P.M. in said
<br />Merrick County,Nebraska, which premises were devised according to said will and codicil thereto
<br />annexed,to said Augusta Stuhr,wife of the deceased,for the termof her natural life,and at her
<br />death,the same shall go to said Clara Peters and to her heirs forever.
<br />THE COURT FURTHER FINDS that the deceased was seised in fee simple of The Westerly Thirty -five
<br />and two- tenths (W.35.2) feet of Lot Eight (15) in Block Twenty -six (26) in Russell Wheeler's Add-
<br />ition to the City of Grand Island,Hall County,Nebraska,aecording to the recorded plat thereof and
<br />the right -of -way over .the Westerly Your (4) feet of the Easterly Seventeen .and six- tenths (17.6)
<br />feet of said Lot Eight (15),subject.to the easement contained in a certain deed recorded in Book
<br />60 of the Deed Records in the Recorder's office of Hall County,Nebraska,at page 1901 which premises
<br />were devised to said Auguste Stuhr in fee simple,to her and to her heirs and assigns forever;that
<br />said Auguste Stuhr did take and accept the provisions made for her in said will and codicil there-
<br />to annexed,as her full share in said premises and in said estate.
<br />THE COURT FURTHER FINDS that Magretha Stuhr at one time reserved a life interest in said premises
<br />in Merrick County under and by virtue of a deed executed on the 9th day of March,l1597 and record-
<br />ed in Book "T" on page 65 of the Deed Records of said Merrick County,of the value of $50.00 per
<br />year for and during the natural life time of the said Magretha Stuhr,which sum of money was paid
<br />the said Magretha Stuhr for each year of her life,as provided in said deed,but which life estate
<br />terminated on the 11th day of August,1916,at which time she depeXted this life.The said Magretha
<br />Stuhr was also known as,and frequently used the name of, "Margaretha Stuhr.
<br />The said deceased Wilhelm Stuhr was also known as "William" Stuhr and at times took conveyances
<br />to real estate in the name of "William Stuhr" as well as "Wilhelm Stuhr."
<br />The executrix herein,Augusta Stuhr,is identical with "Auguste" Stuhr named in the will referred
<br />to in these proceedings.

<br />IT IS THEREFORE ORDERED,ADJUDGED AND DECREE that Auguste Stuhr is entitled to and did take under
<br />said last will and testament of Wilhelm Stuhr,deceased,the Westerly Thirty -five and two- tenths
<br />(W.35.2) feet of Lot Eight (15) in Block Twenty -six (26) in Russell Wheeler's Addition to the City
<br />of Grand Island,Ha11 County,Nebraska, according to the recorded plat thereof and the right -of -way
<br />over the Westerly Four (4) feet of the Easterly Seventeen and six - tenths (17.6) feet of said Lot
<br />Eight (15),subject to the easement contained in a certain deed recorded in Book 60 of the Deed
<br />Records in the Reoorderls office of Hall County,Nebraska,at page 190.in fee simple for herself,
<br />her heirs and assigns forever;that in addition thereto,she was entitled to and did take a life
<br />estate for and during the term of her natural life in and to The Northeast Quarter (NEB) of sect-
<br />ion Twenty -eight (2$_),Townsh1p Thirteen (13) Nor th,Range Seven (7) West _6 P.M.in said Merrick
<br />County,Nebraska that Clara Peters is entitled to and did take a fee simple title subject only to
<br />the life estate for the term of the natural life of the said Auguste Stuhr in and to The "Nor
<br />Quarter (NJ*) of Section Twenty -eight (215),Township Thirteen (13) North,Range Seven (7) West 61v.�.
