W�l <br />TN 9 AUGU$TINEC0.. <br />that I have compared the foregoing copy of Final Decree entered IN THE MATTER OF THE ESTATE OF <br />CLEANTHA A.UNDERWOOD, DECEASED, with the original record thereof, now remaining in said Court, tha <br />the same is a correct transcript thereof, and of the whole of such original record; that said Court <br />is a Court of Record having a seal, which seal is hereto attached; that said Court has no Clerk <br />authorized to sign certificates in his own name, and that I am the legal custodian of said Seal <br />and of the Records of said Court, and that the foregoing attestation is in due form of law. <br />SIN TESTIMONY WHEREOF, I have hereunto set my hand and affixed the seal of the County Court, at <br />,Grand Island, this 5th day of March, 1937- <br />Paul N.Kirk <br />(SEAL) County Judge <br />IFiled for record this 5 day of March, 1937, at 2 :00 o'clock P.N. <br />Register of Deeds <br />0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0--0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0-0- <br />DECREE <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA. <br />In the Matter of the Estate of ) <br />DECREE. <br />Augusta Wallichs Deceased ) <br />Now on this 9th day of March, 1937, this cause came on for hearing upon the petition of Robert L. <br />Stanfield, praying for the settlement of said estate, for a determination of the heirship and r <br />of descent of the real estate belonging to Augusta Wallichs, and the degree of kinship of her he <br />at law, and a decree settling her estate, <br />And it appearing to the court from the proofs on file herein, that due and legal notice has been <br />given by publication for three successive weeks, as by law and the order of this court provided, <br />to all creditors, heirs at law and other persons interested in said estate, of the filing o,g said <br />petition, and of the time and place fixed for the hearing of the same, and there being no objectic <br />thereto, this case was duly submitted to the court upon the petition and the evidence in support <br />thereof, <br />And the Court being duly advised in the premises, finds that the allegations in said petition are <br />true, and that said petitioner, Robert L.Stanfield, is the present owner of an interest in the <br />real estate hereinafter described, and is a competent and proper person to prosecute this proceed- <br />ing; that the said Augusta Wallichs died intestate in Hall County, Nebraska, on the 15th day of <br />February, 1898, and at the time of her death, the said Augusta Wallichs was a resident and inhabi- <br />tant of Hall County, Nebraska, and died seized as the owner in fee simple title to the following <br />described property, to -wit: <br />Lot Nine (9) Block Nineteen (19) Wallich's Addition to the City of Grand Island,Nebraska; <br />that more than 39 years have elapsed since her death, and that no application has ever been made <br />in the state of Nebraska for the appointment of administrator of her estate, and no petition filee <br />for that purpose, and no administration has ever been*had upon the estate of Augusta Wallichs, de- <br />ceased. <br />The court further finds that the said Augusta Wallichs left surviving her as her only heir at law, <br />her father, John Wallichs. <br />The court further finds that under the laws of the state of Nebraska in force at the time of the <br />death oP the said Augusta Wallichs, the real estate hereinbefore described passed and descended <br />by absolute title to her father, John Wallichs. <br />The court further finds that the funeral expenses of said deceased have been fully paid, and that <br />all debts of said deceased and of her estate, if any such existed, are forever - barred and preclude <br />and that the costs of these proceedings have been paid. <br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED by the court that the said Augusta Wallichs died <br />intestate in Hall County, Nebraska, on the 15th day of February, 1895; that more than 39 years <br />I have elapsed between the death of the said Augusta Wallichs, and of the fil-ing: of this petitio <br />t <br />s <br />d, <br />
