62 <br />WILL <br />AND <br />DECREE <br />RECORD <br />,_ _rxetiucusnxeco.8427-5 -33_ <br />!Now on this 2nd day of March, <br />A.D., 1937, <br />this cause came on <br />for hearing upon the final report of <br />Meta W.Frederking, executrix of the Last Will and Te.stameat of A.L.Joseph, deceased, and upon her <br />petition for a settlement of said estate and her discharge, and the Court having examined the recd <br />and files and being duly advised in the premises finds that due and legal notice has been given to <br />all persons interested in said estate, of time and place fixed for the hearing upon said final re- <br />port as heretofore ordered by the Court. <br />And no one appearing to object to said report the Court examined the same, together with the vouch <br />on file and the testimony offered in support thereof and being duly advised in the premises finds <br />that said report is true and correct in all things, and that the same ought to be allowed and appr <br />as and for the final report of said executrix. <br />,The Court further finds that A.L.Joseph departed this life testate on the 20th day of March, 1934, <br />land at the time of his death the said A.L.Joseph was a resident and inhabitant of Hall County, <br />;Nebraska; <br />The Court further finds that on the 26th day of March, 1934, Meta W.Frederking, executrix named <br />in said Last Will and Testament, filed in this Court her duly verified petition praying for the <br />allowance in probate of an instrument proporting to be the Last Will and Testament of A.L.Joseph, <br />;deceased; that the Court thereupon fixed the 18th day of April, 1934, as the day for making proof <br />of said Will and due notice of the filing of said petition and the time and place fixed for the <br />t <br />!hearing thereon was given by the Court in the manner provided by law, and on the 18th day of April <br />11934, being the time fixed for that purpose, said instrument was duly proven, allowed and admitted <br />Ito probate in this 'Court as and for the Last Will and Testament of A.L.Joseph, deceased, and lettE <br />i <br />testamentary were duly issued thereon to the said Meta W.Frederking, the executrix named in said <br />;Last Will, and she duly qualified as such. <br />;The Court further finds that due and legal notice has been given to all persons of the time and <br />!place fixed by the Court for the presentation of claims against said estate and the time so fixed <br />!has fully expired and that all persons having claims against said estate, if arty such there be, <br />fare foreiier barred and excluded from setting up or asserting any such claims against said estate. <br />The Court further finds that the said A.L.Joseph died seized as the owner in fee simple of the <br />following described real estate in Hall County and State of Nebraska, to -wit: <br />Lot Nine (9) in Block Twenty -eight (28) in Russel Wheeler's Addition to, the City of Grand Island, <br />Hall County, Nebraska. <br />The Court finds that the deceased left surviving him as his only heirs at law the following named <br />persons, to -wit: <br />F.J.Joseph, father - <br />Henry J.Joseph, a brother <br />Sophia M.Loescher, a sister <br />Meta W.Frederking, a sister <br />that the said A.L.Joseph's wife predeceased him; that he had no children, and that all of said <br />heirs are of legal age, and that there are no children of any deceased heirs. <br />The Court further finds that by the terms and probate of said Last Will and Testament of the said <br />A.L.Joseph, deceased, the said premises descended as follows, to -wit: <br />Lot Nine (9) in Block Tvienty -eight (28) Russel Wheeler's Addition to the City of Grand Island, <br />Hall County, Nebraska, to <br />Henry J .Joseph, <br />Sophia M.Loescher, <br />and Meta W.Frederking, <br />share and share alike, subject, howver, to the said three (3) legatees and devisees paying to <br />F.J.Joseph, father of A.L.Joseph, deceased, interest due from year to year on a note executed and <br />delivered by the said A.L.Joseph to his father the above named F.J.Joseph. <br />The Court further finds that the final report filed by the said executrix, Meta W.Frederking, of <br />her doings and proceedings in the above estate is correct, and is in all respects approved and <br />rs <br />ed <br />
