<br />That the fair, reasonable, cash value of the property of the deceased, at the time of his death,
<br />was less than the sum of $50,000, and it, or any part thereof, or the right to have, receive and
<br />enjoy-the same, is not liable for or chargeable with any state inheritance or federal estate tax.
<br />That each and all of the acts of the executors are fair, legal and just and upon compliance with
<br />this decree, said executors should be discharged and their bond released and cancelled.
<br />IT IS THEREFORE CONSIDERED, ORDERED AND DECREED BY THE COURT:
<br />That the heirs at law, next of kin, legatees and devisees of the deceased are his wife and childri
<br />hereinbefore named and described.
<br />That all claims, of every nature and kind against the estate of the deceased, should be and the s e
<br />are hereby barred; that the estate of the deceased, or any part thereof, or the right to have,
<br />'receive and enjoy the same, should be and the same is hereby decreed not to be liable for or charg-
<br />eable with any state inheritance or federal estate tax.
<br />That said executors should be and they are hereby ordered to pay to the judge of this court, the
<br />°balance of the court costs herein, the sum of $38.60, and to pay to Sidney M.Binfield and Bert Mott,
<br />in full compensation for their services herein, as executors, the sum of $150.00, and pay to Herm n
<br />G.Schroeder, as compensation for his services as attorney for the executors in said court, the
<br />-of $150.00.
<br />That the balance of the funds in the hands of the executors, the sum of $1200.00 should be and
<br />same is hereby distributed to Olive A.Binfield, Robert L.Binfield and Richard A.Binfield, to each
<br />an undivided 113 thereof, and said executors are ordered and directed to pay the same to them, an
<br />to surrender to them the one white (horse)pony, described in the inventory and the petition for
<br />final settlement herein, under and in accordance with the paragraph of the will of the deceased
<br />designated Third.
<br />That Lots 3 and 4, Block 2, Noran's Addition to the City of Hastings, Adams County, Nebraska, was
<br />and is hereby decreed to be the homestead of the deceased and his wife Olive A.Binfield, at the
<br />time of the death of the deceased, and it should be and is hereby assigned absolutely in fee simp7
<br />to Olive A.Binfield, under and in accordance with the paragraph of the will of the deceased desig-
<br />nated Second.
<br />That there should be and is hereby assigned, absolutely in fee simple, to Olive A.Binfield, the
<br />e
<br />widow of the deceased, an undivided 1/4, and to Olive Ruth Hart, Rosa Ann Binfield, Robert L.Binfield
<br />and Richard A.Binfield, in equal shares, an undivided 3/4 of the following described real estate,
<br />under and in accordance with the paragraph of the will of the deceased designated Fourth, to -wit:
<br />Northeast Quarter, West Half of Southeast Quarter, Northeast Quarter of Southeast Quarter, Lot 2,
<br />Island, Section 10, 'Township 9, Range 11, Hall County, Nebraska
<br />South Half of Southwest Quarter, East Half of Southeast Quarter, Southwest Quarter of Southeast
<br />Quarter, Lots 5, 6,7,8,9,10,Island, Section 2, Township 9, Range 11, Hail County, Nebraska.
<br />Lots 1,2,3,4, Island, Northwest Quarter of Northeast Quarter; Northwest Quarter, Lots 5,6,7,Island
<br />Section 11, township 9, Range 11, Hall County, Nebraska.
<br />Lots 1,2,3,Island, Section 15, Township 9, Range 11, Hall County, Nebraska.
<br />Lot 1, in Northeast Quarter Island, Section 16, Township 9, Range 11, Hall County, Nebraska.
<br />subject, however, to an indebtedness, lien and charge on the part and share of Olive Ruth Hart of
