5,9 0 <br />., THE AUGUSTINE CO. 8427 -5 -33 <br />[County, Nebraska, on the 2nd day of April, 1929, being at the time of her death aM resident and in4 <br />habitant of said County; that more than two years have elapsed since her death and no application ! <br />has been filed in the State of Nebraska -or 41sewhere for the appointment of an administrator of <br />;her estate, and that no administration has been had upon her estate at any place. <br />;The Court further finds that the said deceased left surviving her as her heirs at law, and only <br />heirs at law or persons entitled to share in her estate, the following persons, to -wit: Jefferson <br />?R.Smith, her husband; Malinda Aldrich, Ida Paulsen, Daisey Gray, her daughters; and Williams R. <br />Smith and Fernando Smith, her sons. All of said heirs being of legal age. <br />The Court further finds that said deceased died seized as the owner in fee simple title of the <br />following described premises situated in Hall County, Nebraska,, to -wit: "An undivided 2/60 intere�t <br />iin and to lots one (1),two (2) and three (3) in Block nine (9) in Clarkson's first addition to t <br />village of Alda in Hall County, Nebraska; and that said real estate did, on the death of the said <br />Amy Smith, pass and descend by operation of law, under the law of descent in force in the State o <br />Nebraska, to the -said Jefferson R.Smith, surviving husband, a one -third part therein, and to <br />Malinda Aldrich, Ida Paulsen, Daisey Gray, William R.Smith and Fernando Smith, surviving children <br />two- thirds part therein in equal shares. <br />The Court further finds that more than two years have elapsed since the death of the said deceased.; <br />that she died intestate resident and inhabitant of said Hall County, Nebraska; that her funeral <br />!expenses and all other debts against her estate have been fully paid; that if there are existing <br />:unpaid debts against said estate, they are forever barred and precluded; and that the petitioner <br />herein has paid the costs and expenses of this proceeding. <br />The Court further finds that the petitioner herein has acquired by purchase all right, title and <br />interest of the said Jefferson R.Smith, Malinda Aldrich, Ida Paulsen, Daisey Gray, William R.Smi <br />and Fernando Smith, in and to the premises hereinbefore described through conveyances from them <br />!and their heirs and that she is now the owner of said premises and in possession thereof and as <br />;such, is a proper and qualified person to file this petition. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED by the Court that the said Amy Smith died intestat <br />as above stated, more than two years prior to the filing of the petition in this action; that no <br />application for the appointment of an Administrator of her estate has ever been made, nor has any <br />administration upon her estate ever been had in the State of Nebraska or any where else; that she <br />died seized as the owner of an estate of inheritance in the real .estate above described situated <br />in the Village of Alda, Hall County, Nebraska, and that upon the death of said deceased said real <br />estate did pass and descend by operation of law to the heirs of said deceased as hereinbefore four <br />by the Court and distribution thereof is accordingly made. <br />Paul N.Kirk <br />County Judge. <br />IN THE COUNTY COURT OF HALL.COUNTY,NEBRASKA <br />CERTIFICATE. <br />STATE OF NEBRASKA )ss <br />HALL COUNTY ) I, Paul N.Kirk, County Judge of Hall County, Nebraska, d3 hereby certi <br />that I have compared the foregoing copy of decree of heirship in the matter of the estate of Amy <br />Smith deceased, with the original record thereof, now remaining in said Court, that the same is a <br />correct transcript thereof, and of the whole of such original record; that said Court is a Court c <br />Record having a seal, which seal is hereto attached; that said Court has no Clerk authorized to <br />sign certificates in his own name, and that I am the legal custodian of said Seal and of the Recoz <br />of said Court, and that the foregoing attestation is in due form of law. <br />I further certify # # # ## <br />IN TESTIMONY WHEREOF, I have hereunto set my hand and affixed the seal of the County Court, at <br />Grand Island, this 10th day of June, 1932.
