<br />OF MALINDA SHRINER, DECEASED. )
<br />Now on this 20th day of October, 1931, this cause came on for hearing on the petition of Catherine
<br />Rickard, praying that the court determine and find the date of the death of Malinda Shriner, deceased,
<br />that the said Malinda Shriner died intestate; that the heirs at law of the said Malinda Shriner
<br />be determined by the court and their respective degrees of kinship fixed and that the right of des
<br />cent of the real estate of the said Malinda Shriner, deceased, be determined and it appearing to
<br />the court from the Proofs on file that due and legal notice by publication has been given as by
<br />and the order of this court required to all creditors, heirs and persons interested in the estate
<br />of the said deceased of the time of the filing of , said petition and of the time and place fixed
<br />the hearing thereon, which time was for more than three weeks previous to the date of hearing the
<br />on and there being no objections, thereto, said cause was duly submitted to the court upon the pet�tion
<br />and evidence produced by the petitioner in support thereof and the court being fully advised in
<br />premises advise that the said Malinda Shriner died intestate in Hall County, Nebraska, and that at
<br />the time of her death, the said Malinda Shriner was a resident and inhabitant of Hall County, Ne-
<br />braska, and that she died seized of an estate of inheritance in real estate located in Hall County
<br />Nebraska, consisting of an undivided one -half interest in and to Lots One (1), two (2), and three
<br />(3) in Block Nine (9) in Clarkson's First Addition to the village of Alda in Hall County, Nebraska
<br />'that more than two years have elapsed since the death of the said Malinda Shriner and that no appl
<br />cation has ever-.been made in the state of Nebraska for the appointment of an administrator of her
<br />estate, nor has administration upon the estate of the said Malinda Shriner ever been had in the
<br />state of Nebraska; that the petitioner herein is now the owner of said premises by purchase and
<br />for a competent and proper person to institute and prosecute this proceeding.
<br />IThe Court further finds that the said Malinda Shriner left surviving her, her husband John W.Shr
<br />her children, Sarah A.Abel, Edward B.Shriner, Ellen Tatlow, Margret Oxford, Calvin P.Shriner,
<br />Rebecca J.Moll, William S.Shriner, Joseph D.Shriner, Lottie Gilson and Emma Smith, all of legal

<br />;age; that upon the death of the said Malinda Shriner, under the laws of the state of Nebraska then
<br />lin force, the real estate hereinbefore described passed and descended as follows: one -third thereo

<br />Ito the surviving husband John W.Shriner and the remaining two- thirds thereof descended in equal

<br />Ishares to the children of the said Malinda Shriner, namely Sarah A.Abel, Edward B.Shriner, Ellen
<br />I
<br />Tatlow, Calvin P.Shriner, Rebecca J.Moll, William S.Shriner, Joseph D.Shriner, Lottie Gilson,
<br />Margret Oxford and Amy Smith, subject to the homestead rights of the said John W.Shriner,therein.
<br />The court further finds that the said Malinda Shriner, deceased, left a personal estate sufficient
<br />jto pay her funeral expenses and debts, and that such funeral expenses and debts have been fully
<br />paid; that if any debts existed against the estate of the said Malinda Shriner, deceased, such
<br />debts are long since barred by the Statute of Limitations and are now forever barred and precluded
<br />and the court further finds that the costs of this proceeding have been paid in full.
<br />The court further finds that at the death of the said Malinda Shriner, said real estate hereinbe-
<br />fore described was of the value of about-Seven Hundred Fifty Dollars and that it is now of the

<br />gross value of about Seven Hundred Fifty Dollars.
<br />JIT IS THEREFORE ORDERED, ADJUDGED AND DECREED BY THE COURT, that the said Malinda Shriner died
<br />intestate at Alda, Nebraska; that she died on the 18th day of November, 1918 and that at the time
<br />!of her death she was a resident and inhabitant of Alda, Nebraska; that more than thirteen years
<br />have elapsed since the death of the said Malinda Shriner, that no administration has ever been had
<br />or apolied for upon the estate of the said Malinda Shriner, deceased, in the state of Nebraska;
<br />Ithat the said Malinda Shriner, died seized as the owner in fee simple of an estate of inheritance
