In the event of my death, I desire that all my just debts and funeral expenses shall be first paid

<br />I give, devise and bequeath unto my beloved friend, Kurtes Tyler, who has been a member of and
<br />issoeiated with my family and relatives for many years, the sum of Seven Thousand Five Hundred
<br />Dollars ($7,500.00) to him and to his heirs and assigns for ever.

<br />I hereby give, devise and bequeath unto my beloved daughter, Rosa Thomas all the rest and residue
<br />f my estate, both real and personal and wherever situated, to her and to her heirs and assigns
<br />forever, and in the event of her death, this bequest to go to the children of her, the said Rosa
<br />homas.
<br />1V.
<br />I further provide in this will that if either of the beneficiaries herein named shall contest the
<br />visions of this will or attempt in any manner to break the same or annul the same, that in that
<br />event, the devise and bequest made to said person shall lapse and the property hereby devised and
<br />queathed to said person shall descend to and become the property of the non- contestant benefi-
<br />ciary in this will.

<br />I have carefully considered the question of the final disposition of my property. I realize that
<br />Kurtes Tyler is entitled to some part of my estate. I have discussed the question of the bequests
<br />herein made with friends and with the respective parties and attorneys, and have concluded that th
<br />foregoing bequests are proper, just and equitable. And I further provide in this will that the
<br />acceptance by either of the beneficiaries named herein, of the bequests to such persons provided
<br />for herein shall be considered and treated as a waiver of any other claim against my estate and
<br />that in the event of any assertion of any other claim against my estate by either of the beneficia'
<br />ries named herein, the devise and bequest to such beneficiary provided for in this will shall laps
<br />and the property devised and bequeathed to said person shall descend to and become the property of
<br />the other, any of the provisions in this will to the contrary not withstanding.

<br />I request the appointment of W.A.Prince, who has been my attorney and who is familiar with my
<br />affairs and knows my wishes, as executor of this, my last will and testament, with such bond to bed
<br />given by him for performing the duties of said executor as to the court shall seem just and equit-
<br />able.
