<br />` 1 6th P.M.; in Hall County, Nebraska. That more than two years have elapsed since the date of the
<br />death of the said Minnie Kelly, and no application for the appointment of an administrator of her
<br />estate has been made in the State of Nebraska by her heirs, or persons claiming to be creditors
<br />of the said estate. That the said Minnie Kelly's husband predeceased her, he having died on date
<br />of January 20, 1920; that she never re- married, and that the said Minnie Kelly left surviving her
<br />her following named children who are her sole and only heirs at law, to -wit:
<br />Ernest Kelly, a son, of Sterling, Illinois
<br />Emmett Kelly, a son, of Sterling, Illinois.
<br />Joseph Kelly, a son, of Sterling, Illinois.
<br />Fred Kelly, a son, your petitioner herein, of Harmon, Lee County, Illinois.
<br />That the said deceased left no other child, or children, nor any child or children of any decease
<br />child surviving; that all of slid children were, at the time of the death of said deceased, and n
<br />are of legal age.
<br />The Court further finds that the petitioner, Fred Kelly, is the owner of an undivided interest in
<br />said real estate, as alleged in his petition herein, and as one of the heirs at law of the said
<br />Minnie Kelly, deceased.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED that the facts herein stated are judicially
<br />established as true; that the said Minnie Kelly died intestate as aforesaid, being the owner of
<br />an undivided interest in said real estate; that her death took place more than two years prior
<br />to the commencement of this proceeding, and that no proceeding has been had for the administrat
<br />of her estate in the State of Nebraska, and all her undivided interest in the real estate herei
<br />before described is hereby assigned and set over to the said heirs at law in equal shares, to -wit
<br />Ernest Kelly, a son,
<br />Emmett Kelly, a son,
<br />Joseph Kelly, a son,
<br />Fred Kelly, a son, your petitioner herein,
<br />as of the date of the death of the said Minnie Kelly, deceased.

<br />such original record; that said Court is a Court of Record having a seal, which seal is hereto
<br />attached; that said Court has no Clerk authorized to sign certificates in his own name, and that
<br />I am the legal custodian of said Seal and of the Records of said Court, and that the foregoing
<br />attestation is in due form of law.
