<br />[That the said deceased left no other child or children, nor any child or children of any deceased
<br />child surviving her; that all of her said children were, at the time of the death of said deceased
<br />and now are of legal age.
<br />The Court further finds that the petitioner, Joseph Foley, is the owner of an undivided interest i
<br />said real estate, as alleged in his petition herein and as one of the heirs at law of the said Mar
<br />Foley.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED that the facts hereinbefore stated are judicially
<br />established as true; that the said Mary Foley died intestate as aforesaid being the owner of an
<br />undivided interest in said real estate; that her death took place prior to the commencement of thi
<br />proceeding, and that no proceeding has been had for the administration of her estate in the State
<br />of Nebraska, and all her undivided interest in the real estate hereinbefore described is hereby
<br />assigned and set over to the said heirs at law in the following shares, to -wit:
<br />James Foley, surviving hausband, an undivided One- thirty -third (1133 ) interest.
<br />Loretta Foley Dawson, daughter, an undivided One- ninety -ninth (1/99) interest.
<br />Vera Foley Adams, daughter, an undivided One- ninety -ninth (1/99)
<br />Ruth Foley Schauff, daughter, an undivided One- ninety -ninth (1/99)•
<br />George Foley, son, an undivided One- ninety -ninth (1/99).
<br />Eva Foley Egan, daughter, an undivided One- ninety -ninth (1/99)•
<br />Joseph Foley, son, an undivided One- ninety -ninth (1/99)•

<br />Now on this 21st day of December, 1936, this cause came on for hearing before the Court upon the
<br />petition of Fred Kelly for determination of heirship in the matter of the estate of Minnie belly,
<br />deceased. Thereupon evidence was duly introduced and the said cause submitted to the Court. The
<br />Court finds from the evidence, and from the files and records in the said cause that due notice
<br />of the time and place fixed for the hearing of the said petition has been given by publication
<br />according to the order of the Court heretofore made and entered; finds that the said Minnie Kelly
<br />died intestate on October 20, 1932, being a resident and inhabitant of Lee County, Illinois and
<br />being seized of an undivided One- eleventh (1 /11) interest in the North Half (NJ) of the Northeast
<br />Quarter (NE *) of Section Thirty -four (34), Township Nine (9) North, Range Nine (9) West of the
