<br />Now on this 21st day of December, 1936, this cause came on for hearing before the Court upon the
<br />!petition of Joseph Foley for determination of heirship in the matter of the estate of Mary Foley,
<br />;deceased. Thereupon evidence was duly introduced and the said cause submitted to the Court. The
<br />Court finds from the evidence and from the files and records in said cause that due notice of the
<br />time and place fixed for the hearing of said petition has been given by publication according to tl
<br />order of the Court heretofore made and entered; finds that the said Mary Foley died intestate on
<br />January 3, 1932, being a resident and inhabitant of Lee County, Illinois, and being seized of an
<br />undivided One - eleventh (1 /11) interest in fee simple in the North Half (NJ) of the Northeast Quar-
<br />ter (NEJ) of Section Thirty -four (34), Township Nine (9) North, Range Nine (9) West of the 6th P.M
<br />in Hall County, Nebraska; that more than two years have elapsed since the date of the death of the
<br />said Mary Foley and no application for the appointment of an administrator of her estate has been
<br />made in the State of Nebraska by her heirs or persons claiming to be creditors of said estate; tha
