Thereupon evidence was duly introduced and the said cause submitted to the <br />Court. The Court finds from the evidence and from the files and records of the said cause that <br />due notice of the time and place fixed for the hearing of the said petition has been given by <br />publication according to the order of the Court heretofore made and entered; finds that the said <br />s P.Sutton died intestate on March 10, 1931, being a resident and inhabitant of Mi mehaha <br />County, South Dakota, and being seized of an undivided One-ninety-ninth (1/99) interest in the <br />North Half (NJ) of the Northeast quarter (NEJ) of Section Thirty -four (34), Township Nine (9) <br />North, Range Nine (9) West of the 6th P.M. in Hall County, Nebraska; that more than two years <br />have elapsed since the date of the death of the said James P.Sutton, and no application for the <br />appointment of an administrator of his estate has been made in the State of Nebraska by his heirs <br />or persons claiming to creditors of the estate. That the said James P.Sutton left surviving him <br />the following named persons as his sole and only heirs at law: <br />Anastasia McCabe Sutton, surviving widow, of Sioux Falls, South Dakota. <br />Julia Sutton, his mother, your petitioner herein, of Larchwood, Iowa. <br />,That the father of the said James P.Sutton, deceased, predeceased him and that he left no survivi <br />children. <br />Toe Court further finds that the petitioner, Julia Sutton, is the owner of an undivided interest <br />in said real estate as alleged in her petition herein, and as one of the heirs at law of the said <br />James P.Sutton, deceased. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED that the facts stated herein are judicially estab- <br />lished as true; that the said James P.Sutton died intestate as aforesaid, being the owner of an <br />
