<br />Now on this 21st day of December, 1936, this cause came on for hearing before the Court upon the
<br />petition of Julia Sutton for determination of heirship in the matter of the estate of James Edward
<br />Sutton, deceased. Thereupon evidence was duly introduced and the said cause submitted to the
<br />Court. The Court finds from the evidence and from the files and records in the said cause that
<br />due notice of the time and place fixed for the hearing of said petition has been given by publi-
<br />cation according to the order of the Court heretofore made and entered; finds that the said James
<br />Edward Sutton died intestate on April 9, 1927, being a resident and inhabitant of Lyon County, Ioi
<br />and being seized of an undivided One- eleventh (1 /11) interest in the North Half (NJ) of the North-
<br />east Quarter (NEJ) of Section Thirty -four (34) Township Nine (9) North, Range Nine (9) West of the
<br />6th P.M. in Hall County, Nebraska; that more than two years have elapsed since the time of the
<br />death -of the said James Edward Sutton, and no application for the appointment of an administrator
<br />of his estate has been made in the State of Nebraska by his heirs or persons claiming to be cred-
<br />itors of said estate; that the said James Edward Sutton left surviving him the following named
<br />persons as his sole and only heirs at law, to -wit:
<br />JU11A Sutton, surviving widow, your petitioner herein, of Larchwood, Iowa.
<br />Thomas Sutton, a son, of Joliet, Wyoming.
<br />;atharine Sutton Steigelmyer, a daughter of Larchwood, Iowa.
<br />Mary Ann Sutton Stewart, a daughter, of Sioux Falls, South Dakota.
<br />Nelly Sutton Kallaher, a daughter, of Larchwood, Iowa.
<br />Martha Sutton McCarthy, a daughter, of Larchwood, Iowa.
<br />James P.Sutton, a son, of Sioux Falls, South Dakota.
<br />That the said deceased left no other child or children, nor any child or children of any deceased
<br />child surviving; that all of said children were, at the time of the death of said deceased, and nc
<br />are of legal age.
<br />The Court finds that the petitioner, Julia Sutton, is the owner of an undivided interest in said
<br />real estate as alleged in her petition herein, and as one of the heirs at law of the said James
<br />Edward Sutton, deceased.
<br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED that the facts herein stated are judicially estab•
<br />lished as true; that the said James Edward Sutton died intestate as aforesaid, being the owner of
<br />an undivided one- eleventh (1 /11) interest in the real estate hereinbefore described; that his
<br />death took place more than two years prior to the commencement of this proceeding, and that no
<br />proceeding has been had for the administration of his estate in the State of Nebraska, and all
<br />his undivided interest in the real estate hereinbefore described is hereby assigned and set over
<br />to the said heirs at law in the following shares, to -wit:
<br />Julia Sutton, surviving widow, your petitioner herein, an undivided One- thirty -third (1/33) inter
<br />To each of said other heirs above named, being the children of the said deceased, an undivided
<br />One- ninbjty- zh1iftth.(l /99) interest.
