<br />IN THE COUNTY COURT OF MALL COUNTY, NEBRASKA
<br />IN THE MATTER OF )

<br />This matter coming on this day to be heard on the final report of Amelia H.Mattke, executrix in
<br />the above estate, there being present in Court Herbert F.Mayer, attorney for the said Amelia H.
<br />Mattke and for said estate, and after argument of counsel, and no ob4ections having been filed,
<br />;nor has anyone appeared in opposition to said report, the Court finds that said report has been
<br />approved by Herbert E.Mattke and Arnold R.Mattke, they being the only persons interested in said
<br />`estate excepting the said Amelia H.Mattke.
<br />'The Court finds that said report is a true and correct statement of the actions of said executrix
<br />!from the 20th day of June, 1933, to the first day of November, 1936, and that said report should
<br />'received and said executrix should be discharged from further accounting herein.
<br />The court further finds that the said Herman O.Mattke departed this life a resident of said Hall
<br />County on the 16th day of May, 1933, while temporarily absent therefrom upon a visit to Long Beach,
<br />California, and that on the 27th day of May, 1933, a petition by the said Amelia H, Mattke and
<br />(Arnold R.Mattke was filed in this Court, praying for the admission to probate of the last will of
<br />;said deceased; that upon due notice given according to law by publication in the Grand Island Inde
<br />;pendent, said will was admitted to probate which will is in the following words and figures, to -wilt:
<br />LAST WILL AND TESTAMENT OF HERMAN O.MATTKE
<br />I. Herman O.Mattke, of Grand Island,County of Hall and State of Nebraska, being of sound mind and
<br />,disposing memory, do make, publish and declare this to be my last will and testament, hereby rev
<br />ing all former wills and testamentary instruments by me made.
<br />1. I order and direct that my Executors shall pay all of my just debts, and the expenses attend-
<br />ing my last illness and burial as soon after my decease as conveniently may be done.
<br />2. After the payment of such debts and expenses, I give, devise and bequeath a life estate interelst
<br />in Ahd to all of the rest, residue and remainder of my estate, both real and personal, to my belo*d
<br />wife, Amelia H.Mattke, to have the same for and during the period of her natural life; and upon
<br />death, the same shall be divided equally, share and share alike, between our two sons, Herbert E.
<br />Mattke and Arnold R.Mattke, to have the same absolutely.
