1 <br />1 <br />547 <br />Jand,the following names children and sole surviving heirs at law of Emma Harder 81attery, a <br />deceased daughter of the said James Harder, deceased, to -wit: <br />Frances Slattery, age 17 years, residing at Grand Island,Nebraska, <br />Evelyn Slattery, age 16 years, residing at Grand Island,Nebraska, <br />The court further finds that the said James Harder was, at the time of his death, the owner of <br />Lot Five in Block seventy -four (74) of the original town, now city of Grand Island, Nebraska, that <br />under the law of descent of of the state of Nebraska, said real estate passed and descended as <br />follows, to -wit: <br />One -sixth thereof to John Harder, <br />one -sixth thereof to Ernest J.Harder <br />one -sixth thereof to Frances Jensen, <br />one -sixth thereof to Hans J.Harder, <br />one -sixth thereof to Rudolph H.Harder, <br />one - twelfth thereof to Frances Slattery, <br />one - twelfth thereof to Evelyn Slattery <br />The court further finds that the said James Harder left no surviving widow, and that the above <br />named heirs are his children and grandchildren. <br />The court further finds that the above described premises have been sold by all of the heirs who <br />are of age and that the proceeds thereof were paid to the administrator and that the same were <br />accounted for in his final report filed herein, that the said Evelyn Slattery is a minor, and <br />that she did not execute a deed for her share of said property and that she is still the owner <br />of an undivided one - twelfth interest in the above described property. <br />It is therefore considered by the Court that the report of the administrator be and the same is <br />hereby approved and allowed as and for his final account and he is discharged of his trust. <br />It is further considered and adjudged by the court that all persons are forever barred from filing <br />or setting up any claims or demands against the estate of James Harder, deceased. <br />The court further finds that the property belonging to said estate has been appraised for the <br />purpose of fixing inheritance tax, and that from the appraiser's report and proof on file, the <br />court finds that said estate is not subject to any inheritance tax whatsoever. <br />It is therefore considered, adjudged and decreed by the court that the personal property remain- <br />ing in the hands of the administrator when said report was filed, has been distributed among the <br />heirs entitled to the same, and that there remains no personal property in his hands for distribu- <br />tion. <br />It is further considered, adjudged and decreed by the court that all of the right, title and <br />interest of James Harder, in and to Lot Five in Block Seventy -four (74) of the original town, <br />now city of Grand Island,Nebraska, did pass and descend at his death, under and by virtue of the <br />law of descend of the state of Nebraska, in the manner following: <br />one -sixth thereof to John Harder, his son, <br />one -sixth thereof to Ernest J.Harder, his son, <br />one sixth thereof to Frances Jensen, his daughter, <br />one -sixth thereof to Hans J.Harder, his son, <br />one - sixth thereof to Rudolph H.Harder, his son, <br />one - twelfth thereof to Frances Slattery, and one - <br />twelfth'.the.reaf to " Evelyn Slattery, daughters of Emma Harder Slattery, <br />a deceased daughter.of the said James Harder, deceased. <br />It is further ordered,'adjudged and decreed by the court that the above described real estate, <br />except the share of Evelyn Slattery has been sold; and the proceeds thereof paid to the adminis- <br />trator and distribution of said proceeds has been made by him, and that the said Evelyn Slattery <br />is the owner of an undivided one - twelfth interest in and to the above described premises. <br />It is further ordered, adjudged and decreed by the court that the administrator of said estate be <br />discharged of his trust, and his bond has such administrator released. <br />Dated this 9th day of April, 1935. <br />Paul N.Kirk <br />County Judge <br />IN THE COUNTY COURT OF HALL COUNTY,NEBRASKA <br />CERTIFICATE <br />STATE OF NEBRASKA 3ss� I, Paul N.Kirk, County Judge of Hall County, Nebraska, do hereby certify <br />HALL COUNTY _ that _1_h_&ts..ccm]par q4 the ,Xlorpga nng copy of Final Decree entered TN THE <br />
