532 <br />THE AUGUSTINE CO..�SV� /_J <br />'FINAL DECREE <br />IN THE MATTER OF <br />THE ESTATE OF <br />JACOB NAUMANN, deceased. <br />IN THE COUNTY COURT OF HALL COUNTY, NEBRASKA <br />FINAL DECREE. <br />This cause coming on to be heard this first day of October, 1936, upon the final report of the <br />executor herein, there being present Herbert F.Mayer, one of the attorneys for this estate, and <br />upon examination of the files, the Court finds that Ernest G.Kroger, the duly appointed, qualifies <br />and acting executor herein, filed his final report in this court on the 5th day of September, 193, <br />showing receipts and expenditures by him made, praying for an order directing the approval of sail <br />report and for his discharge from further acting as such executor. <br />4 <br />The Court further finds that on said 5th day of September, 1936, an order was made setting down <br />for hearing said final report and application, for approval thereof on the first day of October, <br />11936, at 10 o'clock A.M. and that notice of said order was published once a week for three weeks <br />I <br />in the Grand Island Independent, a legal newspaper printed in said Hall County, Nebraska, accordir <br />I to the proofs on file; <br />The Court further finds that no objections have been filed nor has anyone appeared in opposition <br />to the approval of said report, and the Court finds said report true and correct in all things, <br />that the expenditures shown therein are proper charges against said estate and that said report <br />should be approved. <br />IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that said report.be and is hereby approved as and fc <br />the final report of said executor herein and that he be dischargeyi I from further acting in this <br />cause and his bond released. <br />This cause coming on further to be heard, the court finds that Jacob Nauman departed this life a <br />resident of Hall County, Nebraska, on the 4th day of August, 1933, testate, leaving a last will i <br />which Ernest G.Kroger is named executor and that said will was filed in this Court with petition <br />for probate thereof on the 11th day of August, 1933, and after due notice given by publication in <br />zthe Grand Island Independent, a legal newspaper printed in said county, for three successive weeks <br />,prior to the day of hearing thereon, said will was admitted to probate on the 5th day of Septembe , <br />1933, which will is in words and figures as follows, to -wit: <br />LAST WILL OF JACOB NAUMANN OF CAIRO, NEBRASKA. <br />IN THE NAME OF GOD, AMEN. <br />I, Jacob Naumann, of Cairo, Hall County, Nebraska, being of sound mind and memory, and consider <br />the uncertainties of this mortal life, do hereby make, publish and declare this my last will and <br />testament, in words and figures following, to -wit: <br />1. <br />I direct that all of my just debts, including the expense of my last sickness, death and burial, <br />be paid out of my personal estate as soon as can conveniently be done after my death. <br />2. <br />To my beloved son, John Naumann, I give and devise the Southwest Quarter of the Southwest Quarter <br />(SW {SWs) and the East Half of the Southwest Quarter (EJSW *) and, the West Half of the Southeast <br />Quarter (W *SE4) of Section Fifteen (15), Township Twelve (12) North, Range Eleven (11), West of <br />the 6th P.M., Hall County, Nebraska, to have and to hold to him and his heirs, forever, subject <br />however to a charge of Five Hundred ($500.00) Dollars in favor of my son Otto Naumann, to be paid <br />to him when my son Otto starts building a house on the land hereinafter devised to him, but in any <br />event to be paid to him within three (3) years after my death. No interest on said sum is to be <br />paid so long as my son Otto makes his home with my son John, but interest is to be computed at the <br />
