<br />ber, 1935, notice of which was duly published for three successive weeks in the Grand Island Daily
<br />Independent, a legal newspaper printed in said County ;' that said notice was published three suc-
<br />cessive-times and upon proof being duly made, said will was admitted to probate on the 24th day of
<br />December, 1935, as the genuine and valid will of said deceased and that Eddie Bennetsen and Harry
<br />Bennetsen were appointed executors and duly qualified by filing their bond in the sum of $10,000.
<br />and taking the oath of office, that Kyerstine Bennetsen named in said will is the widow of said
<br />deceased and also known as Christine Bennetsen.
<br />The Court further finds that the said Just E.Bennetsen died seized of the following described real
<br />estate situated in Hall County, Nebraska, to -wit: South Half of Lot Eight and the South Half of
<br />Lot Seven, all in Block Nine of Wiebe's Addition to the City of Grand Island, Hall County, Nebraske
<br />also Lot Seven in Block Ninety -five of the Original Town now city of Grand Island,Nebraska.
<br />That on the 8th day of January, 1936, this Court made an order giving notice to creditors for the
<br />filing of claims, hearing on which would be held on the 4th day of May, 1936, and that publication
<br />of such notice was made for three successive weeks in said newspaper.
<br />That in accordance with the provisions of said still, which will has been accepted by said Christine
<br />Bennetsen in lieu of her statutory rights in said real estate and'said personal property, she shall
<br />I.,
<br />receive the income from all real estate, monies, mortgages, stocks, bonds and other choses in action
<br />which investments shall be held by said Eddie Bennetsen and Harry Bennetsen as trustees, which in-
<br />come shall be paid to her from time to time and in the event that she may need more than such inc
<br />the Trustees are directed to pay her out of such trust as much money as may be necessary to comf
<br />!ably keep her, and at her death said trust shall be wound up as soon as that can conveniently be
<br />tdone, and shall be divided in like parts among his sons Eddie Bennetsen and Harry Bennetsen and hiE
<br />!daughters Hazel Runge, Myrtle Fowler and Frieda Linderkamp, and to their respective heirs.
<br />'The Court further finds that a petition was filed herein for authority to transfer the following
<br />investments, stocks, bonds and choses in action, to said trustees to be held for the purposes set
<br />Torth in this decree and in said will, as followsi
<br />20 shares of capital stock in Occidental Building & Loan Association
<br />1,2 participation certificates No. 149 and 150 in assets of Nebraska National Bank
<br />e5 shares common stock In Overland National Bank, Certificate No. 22
<br />2 real estate mortgage executed by Charles T.Lauritzen for $2,000.
<br />14 bonds of "The Poor Sisters of St.Francis"
<br />X101 shares of capital stock in the Cities Service Co.
<br />that said executors have transferred said investments, stocks and bonds and that the same are
<br />held by the trustees for said Christine Bennetsen and for the legatees named in said will.
<br />e Court further finds that said estate is not subject to estate taxes on the part of the United
<br />e,
<br />tates Government nor are the executors or the heirs liable for the payment of any inheritance taxes
<br />e the County of Hall or State of Nebraska; that all court costs, attorneys fees and other fees
<br />e been paid; that everything that should have been done has been done and that said estate
<br />closed.
<br />T IS THEREFORE ORDERED, ADJUDGED AND DECREED that Christine Bennetsen, according to the terms of
<br />id will, has and is entitled to the use of all income from said estate for and during the term of
<br />r natural life time and that upon her decease, said real estate, to -wit:
<br />outh Half of Lot Eight and the South Half of Lot Seven, all in Block Nine of Wiebe's Addition to
<br />he City of Grand Island,Hall County, Nebraska, also
<br />of Seven in block Ninety -five of the Original Town now city of Grand Island,Nebraska, and
<br />ersonal property shall go to Eddie Bennetsen, Harry Bennetsen, Hazel Runge, Myrtle Fowler and Frig
<br />inderkamp, the heirs at law and only heirs at law, legatees and devisees of the said Just E.Bennel
<br />en, and to their respective heirs and assigns forever.
