<br />IT IS,THEREFORE,CONSIDERED by the Court that under the terms and provisions of the last will and
<br />testament of said Emil Wolbach,deceased,all of the above mentioned real estate did pass and descen
<br />at his death,to Murray Wolbach and Edwin J.Wolbach,residuary legatees under the last will and test-
<br />ament of said deceased,each taking an undivided one -half interest therein,in fee simple.

<br />DF PHILANDER B. WICKHAM,DECEASED
<br />11ow on this 16 day of September,1936,this cause came on for hearing upon the petition of Roy Hutto
<br />praying for the settlement of said estate,f or a determination of the heirship and right of descent
<br />of the real estate belonging to Philander B.Wickham,and the decree of kinship of his heirs at law, I
<br />and a decree settling his estate, And it appearing to the court from the proofs on file herein that
<br />iue and legal notice has been given by publication for three successive weeks,as by law and the
<br />Drder of this court provided,to all creditors,heirs at law and other persons interested in said
<br />astate,of the filing of said petition,and of the time and place fixed for the hearing of the same,
<br />and there being no objections thereto,this case was duly submitted to the court upon the petition
<br />and the evidence in support thereof,and the court being duly advised in the premises,finds that the
<br />allegations in said petition are true, and that said petitioner,Roy Hutton,is the present owner of
<br />the real estate hereinafter described,and is a competent and proper person to prosecute this pro -
<br />,odeding;that the said Philander B.Wickham died intestate in Hall County,Nebraska,on the 29th day of
<br />Lpril,1897;and at the time of his death,the said Philander B.Wickham was a resident and inhabitant
<br />)f Hall County,Nebraska,and died seized as the owner in fee simple title of the Northeast Quarter
<br />)f the Northwest Quarter (N* NWJ),the South half of the Northwest Quarter (SJ NWJ) and the North
<br />'calf of the Southwest Quarter (NJ SW J) all in Section Seven (7) Township Eleven (11) North,Range
<br />Eleven (11),West of the 6th P.M.in Hall County,Nebraska;that more than 35 years have elapsed since
<br />ais death,and that no application has ever been made in the state of Nebraska for the appointment
<br />pf administrator of his estate,and no petition filed for that purpose,and no administration has eve
<br />been had upon the estate of Philander B.Wickham,deceased.
<br />e court further finds that the said Philander B.Wickham left surviving him as his heirs at law
