That on the 27th day of August, <br />1931, said instruments to which this certificate is attached were duly proved, probated and allow d <br />as the last will and testament and Codicil thereto of the real and personal estate of said John <br />Spiehs, deceased, and the same were ordered to be recorded in the records of the Court aforesaid. <br />IN WITNESS WHEREOF, I have hereunto set my hand and affixed the seal of the County Court this 27 <br />a day of August, 1931. <br />j <br />Paul N.Kirk <br />(SEAL) County Judge. <br />IN THE COUNTY COURT OF HALL COUNT`2 NEBRASKA. <br />In the Matter of the Estate ) <br />of ) FINAL DECREE. <br />'John Spiehs, deceased. ) <br />Now on this 2411 day of April, 1934, this cause came on for hearing upon the final report of SophiE <br />Spiehs and J.L.Cleary, Executrices under the last will and testament of John Spiehs, deceased, <br />upon their petition for the approval and allowance of said report, the settlement of said estate, <br />j and their discharge herein, and the Court having examined the records and files and being duly <br />advised in the premises finds that due and legal notice has been given to all persons of the time <br />and place fixed for the hearing upon said report, as heretofore ordered by the Court, and the C <br />having examined said report, together with the vouchers on file, and being fully advised in the <br />premises, finds that said retort is true and correct in all things and that the same ought to be <br />approved and allowed as and for the final report of said Executrices. <br />The Court further finds that due and legal notice has been given to all persons of the time and' <br />place fixed by the Court for the filing of claims against said estate, and that the time so fixed <br />,has fully expired, and that all persons having claims against said estate,if'.any such there be, <br />are forever barred, and ex:ciuded from setting up or asserting any such claims against said estate. <br />;The Court finds that the said Executrices have paid the funeral expenses of said deceased, and the <br />costs of this proceeding, and all claims against the estate, including those filed as well as othe <br />;The Court finds that there has come into the hands of Executrices the sum of $290.00. That they <br />have paid out in various disbursements the sum of $3754.83. That the excess of disbursements ove <br />!receipts in the sum of $3465.83 has been paid from the personal funds of Sophie Spiehs, widow and <br />!Executrix and sole legatee of the personal property of said estate, and by reason of her being th <br />sole legatee of the personal property in said estate she makes no claim for the sums so advanced <br />3 <br />to pay excess of disbursements over receipts. <br />The Court finds that said estate was not subject to tax under the State Inheritance Tax or Fede <br />Estate Tax. <br />The Court finds that the said John Spiehs died seized as the owner by fee simple title of: <br />The Northwest Quarter, and the North Half of-the Southeast Quarter and the North Half of the Sou <br />west Quarter, all in Section 25, Township 12j North Range 11, West, except the right of way of t <br />Burlington and Missouri Railroad Company, containing 9.20 acres; <br />The North three - quarters of the Northwest Quarter, consisting of parts of Lots 1 and 2 on the Mair <br />land and part of Lots 3 and 4 on the Island, all in Section 17, Township 10, Range Ten, West of tk <br />6th P.M., the intention being to transfer to grantee named all of those portions of the lots des- <br />cribed which are included in the said North three- quarters of the Northwest Quarter of said Sectic <br />17; <br />All in Hall County, Nebraska. <br />The Court finds that the said John Spiehs left surviving him as his heirs at law, and his only <br />heirs at law aryl the only persons interested in his estate the following named: <br />Sophie Spiehs, his widow, of Hall County, Nebraska, <br />Gehrt Spiehs, a son, of Hamilton County, Nebraska, <br />John Spiehs, a son, of Hall County, Nebraska, <br />Charles Spiehs, a son, of Hall County, Nebraska, <br />Alma Schwartz, a daughter, of Hall County, Nebraska, <br />Richard Spiehs, a son, of Hall County, Nebraska, <br />
