1 <br />1 <br />1 <br />9 C! <br />CODICIL TO LAST WILL AND TESTAMENT OF JOHN SPIEHS <br />This is a codicil to my last will and testament bearing date October 8th, 1929. <br />I direct that the Sixth Paragraph on Page two of my last will and testament be changed so that <br />the bequest therein provided for my son Karl Spiehs shall be the sum of $2000.00 instead of <br />$1,000.00 and that the bequest to my daughter, Alma Schwartz shall be the sum of $3000.00 instead <br />of the sum of $3500.00. <br />This will necessitate a change in the second section of said Paragraph Six providing that the sum <br />remaining for distribution shall be $2500.00 instead of $3000.00. These changes will make the Sixt <br />Paragraph of my said will read as follows: <br />"From the payments required to be made within a year following the death of my said wife, Sophie <br />Spiehs, and aggregating $20,000.00 and which I direct shall be a lien on said respective pieces of <br />real estate tib the extent of the amount required to be paid by each devisee taking the different <br />parcels of land, I direct that there be paid as follows: To my son, Gehrt Spiehs, the sum of <br />$2000.00, to my son, John Spiehs, the sum of $2000.00, to my son Karl Spiehs, the sum of $2000.00, <br />to my daughter Alma Schwartz, the sum of $3000.00, to my son Ferdinand Spiehs the sum of $3000.00, <br />to my son, Richard Spiehs, the sum of $3500.00 and to my daughter Sophie Morris the sum of $2000.0 <br />The remaining $2500.00, being the amount remaining from said $20,000.00, after the payment of the <br />bequests provided, I direct shall be divided equally between the following named bf my said childr <br />to -wit: Gehrt Spiehs, John Spiehs, Alma Schwartz, Ferdinand Spiehs and Richard Spiehs, living at <br />the time of the death of my said wife, Sophie Spiehs, and in the event that any of said children, <br />to- wit: Gehrt hn Spiehs, Alma Schwartz, Ferdinand Spiehs and Richard Spiehs, shall have preced <br />my said wife in death, leaving issue, I direct that the issue of any of said deceased childeor <br />children shall take the share herein provided for said child or children by right of representation." <br />IN WITNESS WHEREOF I have hereunto set my hand to the above instrument this 28th day of January, <br />1930. <br />Witnesses: <br />Bernice E.Matthews <br />John Spiehs _ <br />Gertmwde Waddick <br />J.L.Clear <br />We, the undersigned, whose names are hereto affixed as attesting withesses, do hereby certify <br />that the Testator, John Spiehs, signed the within instrument, being a codicil to his last will <br />and testament of date October 8th, 1929, in our presence and in the presence of each of us; that <br />at the same time in our presence and hearing and in the presence acid hearing of each of us, the <br />said testor pronounced the within instrument as a codicil to his Last Will and Testament of date <br />October 8th, 1929 and we, at his request and in his presence and in the presence of each other <br />have set our names hereto as attesting witnesses. <br />Bernice E.Matthews of Grand Island,Nebraska. <br />Gertrude Waddick of Grand Island, Nebraska. <br />J.L.Cleary of Grand Island, Nebraska. <br />CERTIFICATE OF PROBATE OF WILL AND CODICIL THERETO. <br />State of Nebraska ) <br />)ss. <br />Hall County ) <br />At a session of the County Court held in the County Court Room in Grand Island, in said County, <br />on the 27th day of August, A.D., 1931- <br />Present Paul N.Kirk, County Judge. <br />In the Matter of the Estate <br />of <br />John Spiehs, deceased. <br />I.
