1 <br />. i <br />of the filing of said petition and of the time and place fixed for the hearing thereon, was <br />given by the Court in the manner provided by law,. and on said date said instrument was duly <br />proven, allowed, and admitted to probate in this Court as and for the last will and testament of <br />Pauline Burg, deceased, and letters testamentary were duly issued thereon to Ralph R.Horth, Execu- <br />tor, as named in said last will and testament, and he thereupon duly qualified as such. <br />The Court further finds that said Ralph R.Horth departed this life on the 22d day of September, <br />1934, that as in said last will and testament provided, William Suhr was thereupon named as execu- <br />tor, and he thereupon qualified as such. <br />The Court further finds that due and legal notice has been given to all persons of the time and <br />place fixed for filing claims, and that all claims filed and allowed have been paid, and that the <br />time for filing claims has expired. <br />IT IS, THEREFORE, ORDERED that all claims against said estate, if any such there be, and not filed <br />herein, are forever barred. <br />The Court further finds that Christina Andersen, of Sweden, legatee named in paragraph numbered <br />Fourth of said last will and testament, died prior to the date of the death of the said Pauline <br />Burg, deceased, to- wit; "on the 18th day of June, 1928. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the legacy provided in paragraph <br />numbered Fourth of said last.will and testament to Christina Andersen lapsed. <br />The Court further finds that the Executor has made diligent effort to locate Alice Burg, the <br />legatee named in the Fifth Paragraph of said last will and testament and has made satisfactory <br />showing to this Court of his inability to find said Alice Burg, legatee, and has asked for an <br />order of this Court directing him to pay said bequest to the County Judge of Hall County, Nebraska <br />for the use and benefit of said Alice Burg, legatee. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the Executor pay into the County <br />Court the sum of $500.00 for the benefit of Alice Burg, legatee named in paragraph Fifth of said <br />last will and testament. <br />The Court further finds that said Executor has paid all other legacies provided in said last will <br />and testament, with the exception of the legacy provided in paragraph Fourth, which lapsed prior <br />to the death of said Pauline Burg, deceased. <br />The Court further finds that under paragraph Seventh of said last will and testament, Lulu Neim- <br />berger, is named the devisee of all real estate, to become her absolute property upon arriving at <br />the age of sixty years, and that said Lulu Heimberger arrived at the age of sixty years on the 19t <br />day of February, 1936, and by reason thereof is entitled to full possession of all the real estate <br />described in paragraph Seventh, and the Executor is hereby ordered, and directed to deliver pos- <br />session of said real estate t6 the said Lulu Heimberger. <br />The Court further finds that Pauline Burg at the time of her death was the owner of Lot Two (2) <br />in Block Eighty -Two (82) in the Original Town, now City, of Grand Island,Hall County, Nebraska, <br />and the south half of the south half of the northwest quarter of the southeast quarter of Section <br />Township 35 <br />35, ARange 33 East W.M., presumably in the state of Oregon, together with water contract, and that <br />said real estate, under said last will and testament, was devised to Lulu Heimberger. <br />The Court further finds that there was no inheritance tax, state or Federal. <br />IT IS, THEREFORE, ORDERED, ADJUDGED AND DECREED BY THE COURT that the final report of William - <br />Executor of said last will and testament of Pauline Burg, deceased, be, and the same is hereby <br />approved and allowed as and for his final report, said estate is hereby settled and closed, and <br />said Executor discharged and his bond as such is hereby released. <br />IT IS FURTHER ORDERED, ADJUDGED AND DECREED BY THE COURT that under and by virtue of said last <br />will and testament of Pauline Burg, deceased, the absolute title to the following described real <br />estate, to -wit; <br />
