<br />being the
<br />date fixed for that
<br />purpose, said instrument was duly
<br />proven, allowed, and admitted to probate in this Court as and for the last will and testament of
<br />said Wilhelm Splinter, deceased, and letters testamentary were duly issued thereon to said Willi
<br />Suhr, Executor, as named in said will and he duly qualified as such.
<br />;The Court further finds that due and legal notice has been given to all persons of the time and
<br />place fixed by the Court for the filing of claims against said estate and that the time so fixed
<br />has expired and that all persons having claims against said estate, if any such there be, are f
<br />ever barred and excluded from setting up or asserting any such claims against said estate.
<br />The Court further finds that on the 29th day of September, 1925, Emma Sofia Splinter filed in thi
<br />Court her duly verified petition wherein and whereby she, the said Emma Sofia Splinter, widow of s�ld
<br />Wilhelm Splinter, deceased, elected to take by inheritance, descent, and distribution in the estat
<br />of said deceased as provided by law and declined thereby to take under the last will and testament
<br />of said Wilhelm Splinter, as allowed and proven herein.
<br />The Court further finds that hearing was had on said petition and that said Emma Sofia Splinter,
<br />the widow of said Wilhelm Splinter, deceased, is entitled to take by inheritance, descent, and
<br />distribution the interest in said estate of Wilhelm Splinter under the laws of the state of Nebr
<br />The Court further finds that said Emma Sofia Splinter, widow, of said Wilhelm Splinter, on the 29t
<br />day of September, 1925, filed her petition herein praying that the real estate and premises, to -w :
<br />Lot Three (3) in Block One Hundred Ten (110)2Railroad Addition to the City of Grand Island, in
<br />County, Nebraska, be set aside as her home and homestead, and that hearing was had upon said petition
<br />and the Court finds that said premises and real estate was occupied by said Emma Sofia Splinter
<br />Wilhelm Splinter, on the date of the death of said Wilhelm Splinter, as their home and homestead
<br />sand said Emma Sofia Splinter is entitled to have awarded and decreed to her said premises and real
<br />estate as her homestead, and awarded to her the use of all of the same as her home and homestead
<br />during her life.
<br />!The Court further finds that on the 29th day of September, 1925, said Emma Sofia Splinter, widow,
<br />?filed her petition herein praying that the household furniture and personal effects which do not
<br />exceed the sum of $50.00 in value, be set aside to her and for personal property, to -wit, the sum
<br />of $200.00 be awarded to her as provided by statAv,and that she may be awarded a reasonable sum
<br />for her support during the pendency and settlement of this estate, and the Court finds that said
<br />jEmma Sofia Splinter, widow of said Wilhelm Splinter, deceased, is entitled by law to the household
<br />"furniture and personal effects of said Wilhelm Splinter, deceased, and the sum of $200.00 in lieu
<br />of other personal property and the sum of $50.00 per month for support during the pendency and
<br />settlement of this estate.
<br />The Court further finds that said Emma Sofia Splinter, as the widow of said Wilhelm Splinter, is
<br />entitled to ah undivided one - fourth interest in and to all of the personal and real property of
<br />said Wilhelm Splinter, she being not the parent of any of the children of said deceased, and the
<br />being five children of said deceased, surviving him.
<br />j The Court further finds that under and by virtue of the terms of the last will and testament of
<br />said Wilhelm Splinter, deceased, the daughter Minnie Greb is entitled to a legacy of $25.00 and
<br />the son Wilhelm Splinter is entitled to a gold watch and chain of said deceased, and the widow,
<br />Emma Sofia Splinter, the house -hold furniture, and the children, August Splinter, Wilhelm Splinter,
<br />Augusta Stevens, and Amelia Mattke, in equal shares, the rest, residue, and remainder of the persdn-
<br />al property of said deceased, and receipts on file show that said legacies have been paid and per
<br />sonal property delivered as provided for in said last will and testament.
<br />The Court further finds that the said Wilhelm Splinter died seized as the owner in fee simple of
<br />the following described real estate in Hall County, Nebraska, to -wit:
